Supplementary protection certificates

For the application of this Chapter, with the exception of Article 98, and the provisions based thereon, the following definitions shall apply:

Regulation: Council Regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products (OJ EC L 182), as last amended by Regulation (EC) No 1901/2006 of the European Parliament and of the Council of 12 December 2006 on medicinal products for paediatric use and amending Regulation (EEC) No 1768/92, Directive 2001/20/EC, Directive 2001/83/EC and Regulation (EC) No 726/2004 (OJ EC L 378);

basic patent: a patent as referred to in Article 1, point (c), of the Regulation;

certificate: a supplementary protection certificate as referred to in Article 1, point (d), of the Regulation;

application for extension of the validity period of a certificate: an application for the extension of the validity period of a certificate already granted as referred to in Article 1, under (e), of the Regulation.

Voor de toepassing van dit hoofdstuk, met uitzondering van artikel 98, en de daarop berustende bepalingen, wordt verstaan onder:

verordening: de verordening (EEG) nr. 1768/92 van de Raad van de Europese Gemeenschappen van 18 juni 1992 betreffende de invoering van een aanvullende beschermingscertificaat voor geneesmiddelen (PbEG L 182), zoals deze laatstelijk is gewijzigd bij verordening (EG) nr. 1901/2006 van het Europees Parlement en de Raad van de Europese Unie van 12 december 2006 betreffende geneesmiddelen voor pediatrisch gebruik en tot wijziging van Verordening (EEG) nr. 1768/92, Richtlijn 2001/20/EG, Richtlijn 2001/83/EG en Verordening (EG) nr. 726/2004 (PbEG L 378);

basisoctrooi: een octrooi als bedoeld in artikel 1, onder c, van de verordening;

certificaat: een aanvullend beschermingscertificaat als bedoeld in artikel 1, onder d, van de verordening;

aanvrage om verlenging van de duur van een certificaat: een aanvraag om verlenging van de duur van een reeds verleend certificaat als bedoeld in artikel 1, onder e, van de verordening.
