A patent may be claimed in whole, in part, or with respect to a share therein by the person who, pursuant to Article 11, 12 or 13, or, in the case of a European patent, pursuant to Article 60(1) of the European Patent Convention, has a claim or a joint claim to that patent.

The writ of summons must be entered in the patent register.

3.

The patentee who was in good faith at the time of his application, or who acquired the patent in good faith from a previous holder prior to the registration of the writ of summons, shall remain entitled, with respect to the new patentee, to apply the invention in the manner described in Article 55.

Licenses obtained in good faith prior to registration shall remain valid against the new patent holder, who acquires the right to the remuneration due for the licenses in accordance with Article 56, paragraph 3.

Paragraphs three and four shall not apply in the event that the person who has successfully claimed the patent had already asserted their claims by filing a patent application themselves and the writ of summons, by which the claim for vindication was instituted, was registered within three months after the grant of the patent or, if it concerns a European patent, after the publication in accordance with Article 97(4) of the European Patent Convention of the mention of the grant of the European patent in the patent register.

Pledge rights, established by a former patent holder, are only valid against the new patent holder if they have been acquired in good faith and were established prior to the registration of the writ of summons. They are never valid against the latter in the case referred to in the preceding paragraph.

The claim referred to in the first paragraph shall be time-barred upon the expiry of five years from the day of the grant of the patent or, if it concerns a European patent, from the date on which the mention of the grant of the European patent is published in accordance with Article 97(4) of the European Patent Convention; however, a person who, at the time of obtaining the patent, knew or ought to have known that he, or the person who transferred it to him, had no claim to the patent, may not invoke this limitation period.

As soon as a final decision regarding a claim for recovery has become res judicata or the instance has lapsed, an entry to that effect shall be made in the patent register at the request of the most diligent party.

Een octrooi kan geheel, gedeeltelijk of wat betreft een aandeel daarin worden opgeëist door degene die krachtens artikel 11, 12 of 13 dan wel, indien het een Europees octrooi betreft, krachtens artikel 60, eerste lid, van het Europees Octrooiverdrag aanspraak of mede aanspraak heeft op dat octrooi.

De dagvaarding moet in het octrooiregister worden ingeschreven.

De octrooihouder, die bij zijn aanvrage te goeder trouw was, of die het octrooi voor de inschrijving van de dagvaarding te goeder trouw van een vroegere houder verkreeg, blijft ten aanzien van de nieuwe octrooihouder bevoegd tot toepassing van de uitvinding op de voet als omschreven in artikel 55.

Te goeder trouw voor de inschrijving verkregen licenties blijven geldig tegenover de nieuwe octrooihouder, die overeenkomstig artikel 56, derde lid, recht verkrijgt op de voor de licenties verschuldigde vergoeding.

Het derde en het vierde lid zijn niet van toepassing ingeval degene, die het octrooi met goed gevolg heeft opgeëist, reeds door zelf octrooi aan te vragen zijn aanspraken had doen gelden en de dagvaarding, waarbij de vordering tot opeising werd ingesteld, binnen drie maanden na de verlening van het octrooi of, indien het een Europees octrooi betreft, na de publikatie overeenkomstig artikel 97, vierde lid, van het Europees Octrooiverdrag van de vermelding van de verlening van het Europees octrooi in het octrooiregister was ingeschreven.

Pandrechten, door een vroegere octrooihouder gevestigd, zijn alleen geldig tegenover de nieuwe octrooihouder, indien zij te goeder trouw zijn verkregen en voor de inschrijving van de dagvaarding gevestigd. Zij zijn nimmer tegenover deze geldig in het geval, bedoeld in het vorige lid.

De vordering, bedoeld in het eerste lid, verjaart, wanneer vijf jaren zijn verstreken na de dag van verlening van het octrooi of, indien het een Europees octrooi betreft, na de datum, waarop overeenkomstig artikel 97, vierde lid, van het Europees Octrooiverdrag de vermelding van de verlening van het Europees octrooi is gepubliceerd; nochtans kan degene, die bij het verkrijgen van het octrooi wist of had moeten weten, dat hij of de persoon, die het hem overdroeg, geen aanspraak had op het octrooi, zich niet op deze verjaring beroepen.

8.

Zodra een eindbeslissing aangaande een vordering tot opeising in kracht van gewijsde is gegaan of de instantie is vervallen, wordt daarvan op verzoek van de meest gerede partij in het octrooiregister aantekening gedaan.
