If the licence referred to in Article 57, paragraphs two, four, five or six, has been wrongly refused, the licence shall be granted by the court upon the claim of the interested party. At the request of the plaintiff, the writ of summons shall be entered by the office in the patent register.
If the patent has been granted pursuant to this Kingdom Act, the claimant shall be inadmissible in his legal claim if he does not submit, as an annex to the writ of summons, the result of an investigation into the state of the art regarding the subject matter of the patent for which the licence is claimed, conducted by the Office or by the European Patent Office referred to in the European Patent Convention.
The granting of a licence claimed pursuant to Article 57, paragraph 4, first sentence, may be suspended, with or without a time limit, if, within two months after the service of the writ of summons in which the licence is claimed, a claim for revocation of the patent for which the licence is claimed has been instituted.
The court may, in the description of the granted licence, deviate from what has been requested and may furthermore impose upon the licensee the requirement to provide security within a certain period. A licence granted pursuant to Article 57, paragraph 4, first sentence, may only be transferred together with the patent of the licensee. A licence granted pursuant to Article 57, paragraph 4, first or third sentence, does not lapse because the patent, for the benefit of which the licence has been granted, has ended as a result of the expiry of the term referred to in Article 36, paragraph 6, or has been successfully claimed, but does lapse insofar as the patent has been revoked in whole or in part as a result of the claim referred to in the third paragraph.
A decision as referred to in Article 57, paragraph 1, or a final and conclusive judicial decision shall be entered in the patent register by the office. If the provision of security has been imposed, the entry shall not take place until that obligation has been fulfilled. For the entry, an amount to be determined by or pursuant to an Order in Council shall be payable. The licence shall only take effect after such entry, but shall then also be effective against those who have acquired rights to the patent after the entry of the summons referred to in the first paragraph. An entered licence which has been granted on the basis of Article 57, paragraph 4, shall, however, have retroactive effect up to and including the day on which the summons was entered.
At the request of the most diligent party, the court shall determine the compensation that the licensee must pay to the patent holder in the absence of an agreement. In doing so, the court may impose upon the licensee the requirement to provide security within a specified period, or may confirm or amend the security determined pursuant to Article 57, paragraph 1, or paragraph 5 of this Article.
Indien de licentie, bedoeld in artikel 57, tweede, vierde, vijfde of zesde lid, ten onrechte niet is verleend, wordt de licentie op vordering van de belanghebbende door de rechter verleend. Op verzoek van eiser wordt de dagvaarding door het bureau in het octrooiregister ingeschreven.
Indien het octrooi op grond van deze rijkswet is verleend, is de eiser in zijn rechtsvordering niet ontvankelijk als hij niet bij dagvaarding als bijlage daarbij het resultaat van een door het bureau of het in het Europees Octrooiverdrag bedoelde Europees Octrooibureau ingesteld onderzoek naar de stand van de techniek met betrekking tot het onderwerp van het octrooi, ten behoeve waarvan de licentie is gevorderd, overlegt.
De verlening van een op grond van artikel 57, vierde lid, eerste volzin, gevorderde licentie kan met of zonder tijdsbepaling worden geschorst, indien binnen twee maanden na de betekening van de dagvaarding waarin de licentie is gevorderd, een vordering tot vernietiging van het octrooi, ten behoeve waarvan de licentie is gevorderd, is ingesteld.
De rechter kan bij de omschrijving van de verleende licentie afwijken van hetgeen gevraagd is en kan voorts de verkrijger van de licentie het stellen van zekerheid binnen een bepaalde termijn opleggen. Een op grond van artikel 57, vierde lid, eerste volzin, verleende licentie zal slechts kunnen worden overgedragen tezamen met het octrooi van de licentiehouder. Een op grond van artikel 57, vierde lid, eerste of derde volzin, verleende licentie vervalt niet doordat het octrooi, ten behoeve waarvan de licentie is verleend, als gevolg van het verstrijken van de in artikel 36, zesde lid, bedoelde termijn is geëindigd of met goed gevolg is opgeëist, doch vervalt wel voor zover het octrooi geheel of gedeeltelijk is vernietigd als resultaat van de in het derde lid bedoelde vordering.
Een besluit als bedoeld in artikel 57, eerste lid, of een in kracht van gewijsde gegane rechterlijke uitspraak wordt door het bureau in het octrooiregister ingeschreven. Is het stellen van zekerheid opgelegd, dan heeft de inschrijving niet plaats, voordat aan die verplichting is voldaan. Voor de inschrijving is een bij of krachtens algemene maatregel van rijksbestuur vast te stellen bedrag verschuldigd. De licentie werkt eerst na die inschrijving, maar dan ook tegenover hen, die na de inschrijving van de in het eerste lid bedoelde dagvaarding rechten op het octrooi hebben verkregen. Een ingeschreven licentie, die op grond van artikel 57, vierde lid, is verleend, werkt echter terug tot en met de dag waarop de dagvaarding is ingeschreven.
Op vordering van de meest gerede partij bepaalt de rechter bij gebreke van overeenstemming de vergoeding, die de verkrijger van de licentie aan de octrooihouder dient te betalen. De rechter kan daarbij de verkrijger van de licentie het stellen van zekerheid binnen een bepaalde termijn opleggen, dan wel de op grond van artikel 57, eerste lid, of het vijfde lid van dit artikel bepaalde zekerheid bevestigen of wijzigen.
