The date on which the converted application was received by the office, as well as a serial number, shall be stated on the application. The office shall notify the applicant thereof as soon as possible.
For the converted application, the proof of payment referred to in Article 24, paragraph 5, must be submitted within a period of three months after the date of receipt referred to in the first paragraph. If the European patent application was not filed in Dutch, a translation into Dutch of the original documents of that application must be submitted within the same period. The translation forms part of the converted application; it must, at the request of the Office, be certified within a period to be set by that Office. If the requirements of this paragraph have not been met in due time, the Office shall grant the applicant one opportunity to remedy the default within a period to be set by the Office. If the applicant has not remedied the default in due time, the Office shall decide not to process the application. The Office shall notify the applicant of its decision as soon as possible.
The formal requirements laid down by or pursuant to Article 24 shall not apply to the converted application, insofar as they deviate from or constitute a supplement to that which is determined by or pursuant to the European Patent Convention; in that case, the latter provisions shall apply to the converted application.
As soon as the applicant has complied with the second paragraph, the Office shall verify whether the application complies with the provisions laid down by or pursuant to Article 24 or, if applicable, the provisions of the European Patent Convention referred to in the third paragraph. If this is not the case, or if the publication of the invention would be contrary to public order or morality, the Office shall notify the applicant thereof in writing as soon as possible, stating the requirements that have not been met. Article 30, second paragraph, shall apply mutatis mutandis.
For the application of Articles 31, paragraph 1, 36, paragraph 6, and 61, paragraph 1, to the converted application, the phrase "the date of filing referred to in Article 29, paragraph 1" shall be read as: the date of filing which the application possesses pursuant to Article 80 of the European Patent Convention, with due observance of Articles 61 or 76 of that Convention. By way of derogation from Article 32, paragraphs 1 and 2, a request for a search of the state of the art prior to the grant of the patent in relation to the subject matter of the converted patent application or an application divided therefrom may be filed within two months after the date indicated on the converted application pursuant to Article 48, paragraph 1, or within two months after the filing of the divided application, respectively.
The registration in the patent register referred to in Article 31 shall not take place until it has been established that the requirements referred to in the fourth paragraph have been met or that the deficiencies have been remedied.
Op de omgezette aanvrage wordt de datum, waarop zij bij het bureau is binnengekomen, alsmede een volgnummer vermeld. Het bureau geeft hiervan zo spoedig mogelijk kennis aan de aanvrager.
Voor de omgezette aanvrage moet het in artikel 24, vijfde lid, bedoelde bewijs van betaling worden overgelegd binnen een termijn van drie maanden na de in het eerste lid bedoelde datum van binnenkomst. Indien de Europese octrooiaanvrage niet in het Nederlands is ingediend moet binnen dezelfde termijn een vertaling in het Nederlands van de oorspronkelijke stukken van die aanvrage worden overgelegd. De vertaling maakt deel uit van de omgezette aanvrage; zij moet op verzoek van het bureau binnen een door dat bureau te stellen termijn worden gewaarmerkt. Indien niet tijdig is voldaan aan het in dit lid bepaalde, stelt het bureau de aanvrager eenmaal in de gelegenheid om binnen een door het bureau te stellen termijn zijn verzuim te herstellen. Indien de aanvrager zijn verzuim niet tijdig heeft hersteld, besluit het bureau de aanvrage niet te behandelen. Het bureau maakt zijn beschikking zo spoedig mogelijk aan de aanvrager bekend.
Op de omgezette aanvrage zijn de bij of krachtens artikel 24 gestelde vormvoorschriften niet van toepassing, voor zover zij afwijken van of een aanvulling betekenen op het bij of krachtens het Europees Octrooiverdrag bepaalde; in dat geval zijn laatstbedoelde bepalingen op de omgezette aanvrage van toepassing.
Zodra de aanvrager heeft voldaan aan het tweede lid gaat het bureau na of de aanvrage voldoet aan het bij en krachtens artikel 24 bepaalde of, indien van toepassing, de in het derde lid bedoelde bepalingen van het Europees Octrooiverdrag. Indien dat niet het geval is of indien het openbaar worden van de uitvinding in strijd zou zijn met de openbare orde of goede zeden, geeft het bureau hiervan zo spoedig mogelijk schriftelijk kennis aan de aanvrager, onder opgave van de voorschriften waaraan niet is voldaan. Artikel 30, tweede lid, is van overeenkomstige toepassing.
Voor de toepassing van de artikelen 31, eerste lid, 36, zesde lid, en 61, eerste lid, op de omgezette aanvrage wordt in plaats van "de in artikel 29, eerste lid, bedoelde datum van indiening" gelezen: de datum van indiening die de aanvrage ingevolge artikel 80 van het Europees Octrooiverdrag met inachtneming van de artikelen 61 of 76 van dat Verdrag bezit. In afwijking van artikel 32, eerste en tweede lid, kan een verzoek om een aan de verlening van het octrooi voorafgaand onderzoek naar de stand van de techniek met betrekking tot het onderwerp van de omgezette octrooiaanvrage of een daarvan afgesplitste aanvrage worden ingediend binnen twee maanden na de ingevolge artikel 48, eerste lid, op de omgezette aanvrage vermelde datum onderscheidenlijk binnen twee maanden na indiening van de afgesplitste aanvrage.
De in artikel 31 bedoelde inschrijving in het octrooiregister vindt niet eerder plaats dan nadat is vastgesteld dat aan de in het vierde lid bedoelde voorschriften is voldaan of de gebreken zijn hersteld.
