If the office is of the opinion that the search into the state of the art cannot be carried out due to the lack of clarity of the application, the office shall notify the applicant thereof in writing and with reasons as soon as possible.
If the defects have not been remedied within two months after the dispatch of the notification referred to in the first paragraph, or if the applicant has previously communicated that they do not wish to proceed with the remedy, the office shall decide not to process the application. The office shall notify the applicant of its decision as soon as possible.
Indien het bureau van oordeel is dat het onderzoek naar de stand van de techniek wegens onduidelijkheid van de aanvrage niet uitvoerbaar is, geeft het bureau daarvan zo spoedig mogelijk schriftelijk en met redenen omkleed kennis aan de aanvrager.
Indien de gebreken niet binnen twee maanden na verzending van de in het eerste lid bedoelde kennisgeving zijn hersteld of indien de aanvrager voordien heeft meegedeeld niet tot herstel te willen overgaan, besluit het bureau de aanvrage niet te behandelen. Het bureau maakt zijn beschikking zo spoedig mogelijk aan de aanvrager bekend.
