A search of the state of the art as referred to in Article 32, paragraph 1, shall be conducted by the Office, where necessary with the involvement of the European Patent Office, as referred to in the European Patent Convention.
If the applicant so requests, the office shall cause the application to be subjected to an international-type search of the state of the art as referred to in Article 15(5)(a) of the Patent Cooperation Treaty. Such a search of the state of the art shall be regarded as a search of the state of the art as referred to in Article 32(1).
If, upon examination, it appears that the submitted application does not comply with the provisions laid down by or pursuant to Article 27, it shall be carried out in respect of those parts of the application which relate to the invention or to the group of inventions as referred to in Article 27, which is mentioned first in the claims.
The office shall notify the applicant in writing of the result of the investigation into the state of the art.
If the third paragraph has been applied, the office shall mention this in the notification referred to in the fourth paragraph, stating the invention or group of inventions in respect of which the search has been carried out.
Een onderzoek naar de stand van de techniek als bedoeld in artikel 32, eerste lid, wordt verricht door het bureau, waar nodig met inschakeling van het Europees Octrooibureau, bedoeld in het Europees Octrooiverdrag.
Indien de aanvrager daarom verzoekt, doet het bureau de aanvrage onderwerpen aan een onderzoek naar de stand van de techniek van internationaal type als bedoeld in artikel 15, vijfde lid, onder a, van het Samenwerkingsverdrag. Zulk een onderzoek naar de stand van de techniek wordt aangemerkt als een onderzoek naar de stand van de techniek als bedoeld in artikel 32, eerste lid.
Indien bij het onderzoek blijkt, dat de ingediende aanvrage niet voldoet aan het bij of krachtens artikel 27 bepaalde, wordt het uitgevoerd ten aanzien van die onderdelen van de aanvrage die betrekking hebben op de uitvinding of op de groep van uitvindingen als bedoeld in artikel 27, die als eerste in de conclusies wordt genoemd.
Het bureau deelt de aanvrager schriftelijk het resultaat van het onderzoek naar de stand van de techniek mede.
Indien toepassing is gegeven aan het derde lid, maakt het bureau daarvan in de mededeling, bedoeld in het vierde lid, melding onder vermelding van de uitvinding of groep van uitvindingen ten aanzien waarvan het onderzoek is uitgevoerd.
