There is an examination board for the administration of the examination and the practical test, as referred to in Article 23a.
Upon the recommendation of the board of the order, Our Minister shall appoint the members of the examination board for a term of two years each. Our Minister may dismiss a member in the interim for compelling reasons. The appointment and dismissal of the members of the examination board shall be published in the journal referred to in Article 20.
The examination board shall consist of at least six persons. One-third of the members of the examination board shall be patent attorneys, one-third shall be employees of the office, and one-third shall be technical or legal experts who are not from the circle of patent attorneys or employees of the office. No more than half of the members of the examination board may also be instructors of a training programme for future patent attorneys.
The examination board may compose committees from among its members for the purpose of conducting the examination or the proficiency test in parts.
The examination board shall determine the time for registration for the examination and the test of competence, as referred to in the first paragraph, as well as the time and place at which this examination and this test of competence are to be conducted. The examination board shall not conduct an examination or test of competence, or any part thereof, until the person for whom the examination or test of competence or the part thereof is being conducted has paid the amount due for it.
By or pursuant to an Order in Council, further rules shall be laid down regarding:
admission to participation in and the conducting of the examination and the test of competence, and the amount payable by the person who wishes to participate in an examination or test of competence, or a part thereof;
the knowledge that is assessed by the examination and the proficiency test, the elaboration of the examination requirements by the examination board, and the manner in which the examination or the proficiency test is conducted.
Er is een examencommissie voor het afnemen van het examen en de proeve van bekwaamheid, bedoeld in artikel 23a.
Op voordracht van het bestuur van de orde benoemt Onze Minister de leden van de examencommissie telkens voor een periode van twee jaar. Onze Minister kan een lid om gewichtige redenen tussentijds ontslaan. De benoeming en het ontslag van de leden van de examencommissie wordt bekendgemaakt in het blad, bedoeld in artikel 20.
De examencommissie bestaat uit ten minste zes personen. Een derde van de leden van de examencommissie is octrooigemachtigde, een derde is medewerker van het bureau en een derde is technisch of rechtsgeleerd deskundige, niet afkomstig uit de kring van octrooigemachtigden en medewerkers van het bureau. Ten hoogste de helft van de leden van de examencommissie kan tevens docent zijn van een opleiding voor toekomstige octrooigemachtigden.
De examencommissie kan uit haar midden commissies samenstellen ten behoeve van het in gedeelten afnemen van het examen of de proeve van bekwaamheid.
De examencommissie bepaalt het tijdstip van de aanmelding tot het examen en de proeve van bekwaamheid, bedoeld in het eerste lid, alsmede het tijdstip en de plaats waarop dit examen en deze proeve van bekwaamheid worden afgenomen. De examencommissie neemt een examen of proeve van bekwaamheid of een gedeelte daarvan niet af dan nadat degene van wie het examen of de proeve van bekwaamheid of het gedeelte daarvan wordt afgenomen, het daarvoor verschuldigde bedrag heeft betaald.
Bij of krachtens algemene maatregel van rijksbestuur worden nadere regels gesteld omtrent:
het toelaten tot het deelnemen aan en het afnemen van het examen en de proeve van bekwaamheid en het bedrag dat degene die aan een examen of proeve van bekwaamheid of een gedeelte daarvan wenst deel te nemen, verschuldigd is;
de kennis die wordt getoetst door het examen en de proeve van bekwaamheid, de uitwerking van de exameneisen door de examencommissie en de wijze waarop het examen of de proeve van bekwaamheid wordt afgenomen.
