An invention shall be considered as the result of inventive activity if, for a person skilled in the art, it does not follow in an obvious manner from the state of the art. If documents as referred to in Article 4, paragraphs 3 and 4, belong to the state of the art, these shall be disregarded in the assessment of the inventive activity.
Een uitvinding wordt als het resultaat van uitvinderswerkzaamheid aangemerkt, indien zij voor een deskundige niet op een voor de hand liggende wijze voortvloeit uit de stand van de techniek. Indien documenten als bedoeld in artikel 4, derde en vierde lid, tot de stand van de techniek behoren, worden deze bij de beoordeling van de uitvinderswerkzaamheid buiten beschouwing gelaten.
