1. Member States shall ensure that authors and performers receive on a regular basis, at least once a year, and taking into account the specificities of each sector, up to date, relevant and comprehensive information on the exploitation of their works and performances from the parties to whom they have licensed or transferred their rights, or their successors in title, in particular as regards modes of exploitation, all revenues generated and remuneration due.
2. Member States shall ensure that, where the rights referred to in paragraph 1 have subsequently been licensed, authors and performers or their representatives shall, at their request, receive from sub-licensees additional information, in the event that their first contractual counterpart does not hold all the information that would be necessary for the purposes of paragraph 1.
Where that additional information is requested, the first contractual counterpart of authors and performers shall provide information on the identity of those sub-licensees.
Member States may provide that any request to sub-licensees pursuant to the first subparagraph is made directly or indirectly through the contractual counterpart of the author or the performer.
3. The obligation set out in paragraph 1 shall be proportionate and effective in ensuring a high level of transparency in every sector. Member States may provide that in duly justified cases where the administrative burden resulting from the obligation set out in paragraph 1 would become disproportionate in the light of the revenues generated by the exploitation of the work or performance, the obligation is limited to the types and level of information that can reasonably be expected in such cases.
4. Member States may decide that the obligation set out in paragraph 1 of this Article does not apply when the contribution of the author or performer is not significant having regard to the overall work or performance, unless the author or performer demonstrates that he or she requires the information for the exercise of his or her rights under Article 20(1) and requests the information for that purpose.
5. Member States may provide that, for agreements subject to or based on collective bargaining agreements, the transparency rules of the relevant collective bargaining agreement are applicable, on condition that those rules meet the criteria provided for in paragraphs 1 to 4.
6. Where Article 18 of Directive 2014/26/EU is applicable, the obligation laid down in paragraph 1 of this Article shall not apply in respect of agreements concluded by entities defined in Article 3(a) and (b) of that Directive or by other entities subject to the national rules implementing that Directive.

De lidstaten zorgen ervoor dat auteurs en uitvoerende kunstenaars op regelmatige basis, ten minste eenmaal per jaar, en rekening houdend met de specifieke kenmerken van elke sector, actuele, relevante en volledige informatie betreffende de exploitatie van hun werken en uitvoeringen ontvangen van de partijen aan wie zij hun rechten hebben overgedragen of in licentie gegeven of van hun rechtsopvolgers, met name wat betreft de wijzen van exploitatie, alle voortgebrachte inkomsten en de verschuldigde vergoeding.
2. De lidstaten zorgen ervoor dat wanneer de in lid 1 bedoelde rechten vervolgens in licentie zijn gegeven, auteurs en uitvoerende kunstenaars of hun vertegenwoordigers op hun verzoek aanvullende informatie ontvangen van de sublicentienemers, indien hun eerste contractuele wederpartij niet alle informatie bezit die nodig is voor de toepassing van lid 1.
Wanneer om die aanvullende informatie wordt verzocht, verstrekt de eerste contractuele wederpartij van auteurs en uitvoerende kunstenaars informatie over de identiteit van die sublicentienemers.
De lidstaten kunnen voorschrijven dat verzoeken aan sublicentienemers op grond van de eerste alinea, direct of indirect worden gedaan via de contractuele wederpartij van de auteur of uitvoerende kunstenaar.
3. De in lid 1 bedoelde verplichting is evenredig en doeltreffend voor het waarborgen van een hoog niveau van transparantie in elke sector. De lidstaten kunnen erin voorzien dat in behoorlijk gemotiveerde gevallen waarin de uit de in lid 1 vastgestelde verplichting voortvloeiende administratieve lasten onevenredig zouden worden in het licht van de bij de exploitatie van het werk of de uitvoering voortgebrachte inkomsten, de verplichting wordt beperkt tot het soort en niveau van informatie die in dergelijke gevallen redelijkerwijs mogen worden verwacht.
4. De lidstaten kunnen bepalen dat de in lid 1 van dit artikel vastgestelde verplichting niet van toepassing is wanneer de bijdrage van de auteur of de uitvoerende kunstenaar niet significant is, gelet op het geheel van het werk of de uitvoering, tenzij de auteur of uitvoerende kunstenaar aantoont dat hij de informatie nodig heeft om zijn rechten uit hoofde van artikel 20, lid 1, uit te oefenen en hij met dat doel om de informatie verzoekt.
5. De lidstaten kunnen erin voorzien dat voor overeenkomsten die onderworpen zijn aan of gebaseerd zijn op collectieve overeenkomsten, de transparantievoorschriften van de toepasselijke collectieve overeenkomst van toepassing zijn, op voorwaarde dat die voorschriften voldoen aan de in de leden 1 tot en met 4 vastgestelde criteria.
6. Indien artikel 18 van Richtlijn 2014/26/EU van toepassing is, geldt de in lid 1 van dit artikel bedoelde verplichting niet voor overeenkomsten die worden gesloten door entiteiten als omschreven in artikel 3, onder a) en b), van die richtlijn of door andere entiteiten waarop de nationale voorschriften tot uitvoering van die richtlijn van toepassing zijn.
