Unauthorised absence commences on the day on which the person placed at the disposal of the government or otherwise subject to compulsory care has withdrawn themselves from the execution of the custodial sentence or measure.
Unauthorized absence ends on the day that the person placed at the disposal of the government or otherwise under care reports, is apprehended, or upon the withdrawal of the request for a warrant. This day shall not be included in the duration of the unauthorized absence as referred to in Article 38f, paragraph 1, of the Criminal Code.
The head of the institution for the nursing of persons placed under a hospital order (ter beschikking gestelden) shall request the police to issue a wanted notice for the person placed under a hospital order or otherwise nursed who is unlawfully absent. Our Minister may issue instructions regarding this request as well as the withdrawal thereof.
A record shall be kept of the petition for notification and of the withdrawal of a petition for notification in a register intended for that purpose, which is organised in accordance with a model established by Our Minister.
Our Minister shall be notified without delay of any petition for an alert or a withdrawal of a petition for an alert.
Ongeoorloofde afwezigheid vangt aan op de dag dat de ter beschikking gestelde of anderszins verpleegde zich aan de tenuitvoerlegging van de vrijheidsbenemende straf of maatregel heeft onttrokken.
Ongeoorloofde afwezigheid eindigt op de dag dat de ter beschikking gestelde of anderszins verpleegde zich meldt, hij wordt aangehouden, of door intrekking van het verzoek om signalering. Deze dag wordt niet meegerekend in de duur van de ongeoorloofde afwezigheid, bedoeld in artikel 38f, eerste lid, van het Wetboek van Strafrecht.
Het hoofd van de inrichting voor verpleging van ter beschikking gestelden verzoekt de politie de ongeoorloofd afwezig ter beschikking gestelde of anderszins verpleegde te signaleren. Onze Minister kan aanwijzingen geven ten aanzien van dit verzoek alsmede de intrekking daarvan.
Van het verzoek om signalering en van de intrekking van een verzoek om signalering wordt aantekening gehouden in een daartoe bestemd register dat volgens een door Onze Minister vastgesteld model is ingericht.
Onze Minister wordt onverwijld in kennis gesteld van elk verzoek om signalering of een intrekking van een verzoek om signalering.
