in force(Involuntary) medical treatment
Before the head of the institution decides that a compulsory treatment or a compulsory medical act deemed necessary by the physician shall be performed, the head of the institution shall consult with that physician and with the head of the department where the patient is staying. If the treatment is performed by another physician, consultation shall also take place with him.
In the event of compulsory treatment (b-dwangbehandeling) or if the performance of a compulsory medical act is necessary to avert danger resulting from the mental disorder of the patient, the head of the institution shall, in addition, consult with the psychiatrist responsible for the treatment.
In the consultation referred to in the first and second paragraphs, it shall be examined whether the danger cannot be averted in another manner.
In the situation referred to in Article 26, paragraph 2, of the Act, the head of the department shall conduct the consultation referred to in the first and second paragraphs, respectively. The consultation by the head of the institution with the persons referred to in the first and second paragraphs shall subsequently take place as soon as possible after the commencement of the medical treatment.
Voordat het hoofd van de inrichting beslist dat een door de arts noodzakelijk geachte b-dwangbehandeling of gedwongen geneeskundige handeling zal worden verricht, pleegt het hoofd van de inrichting overleg met die arts en met het hoofd van de afdeling waar de verpleegde verblijft. Indien de behandeling door een andere arts wordt verricht, wordt tevens met hem overlegd.
Ingeval van b-dwangbehandeling of indien het verrichten van een gedwongen geneeskundige handeling noodzakelijk is ter afwending van gevaar dat voortvloeit uit de stoornis van de geestvermogens van de verpleegde, pleegt het hoofd van de inrichting bovendien overleg met de voor de behandeling verantwoordelijke psychiater.
In het in het eerste en tweede lid bedoelde overleg wordt nagegaan of het gevaar niet op een andere wijze kan worden afgewend.
In de situatie bedoeld in artikel 26, tweede lid, van de wet, pleegt het afdelingshoofd het in het eerste respectievelijk tweede lid bedoelde overleg. Het overleg van het hoofd van de inrichting met de in het eerste en tweede lid bedoelde personen vindt vervolgens zo spoedig mogelijk na de aanvang van de geneeskundige behandeling plaats.
