The supervisory authority may, with a view to protecting the interests of the pension beneficiaries or persons entitled to a claim, make a public announcement, if necessary stating the considerations that led to such notification:
violation of the prohibitive provisions of this Act and the offences referred to in Article 201;
the fact in respect of which a direction as referred to in Article 171, paragraph 2, has been issued, the fact that the direction has been issued and the course of action to be followed by the pension fund, as well as the name, the address and the place of establishment of the pension fund to which the direction has been issued;
the fact that a recovery plan as referred to in Article 138 or Article 140 has been submitted, as well as the name, the address and the place of establishment of the pension fund that has submitted the recovery plan.
By regulation of Our Minister, rules may be established regarding the exercise of the powers referred to in the first paragraph.
De toezichthouder kan met het oog op de bescherming van de belangen van de pensioen- of aanspraakgerechtigden ter openbare kennis brengen, indien nodig onder vermelding van de overwegingen die tot die kennisgeving hebben geleid:
overtreding van de verbodsbepalingen uit deze wet en de overtredingen, bedoeld in artikel 201;
het feit ter zake waarvan een aanwijzing als bedoeld in artikel 171, tweede lid, is gegeven, het feit dat de aanwijzing is gegeven en de door de pensioenfonds te volgen gedragslijn, alsmede de naam, het adres en de vestigingsplaats van de pensioenfonds aan wie de aanwijzing is gegeven;
het feit dat een herstelplan als bedoeld in artikel 138 of artikel 140 is ingediend, alsmede de naam, het adres en de vestigingsplaats van het pensioenfonds dat het herstelplan heeft ingediend.
Bij regeling van Onze Minister kunnen regels worden gesteld ter zake van de uitoefening van de bevoegdheden, bedoeld in het eerste lid.
