In addition to Article 19, paragraph 1, of the Framework Act on Autonomous Administrative Bodies, the supervisor shall, with regard to the exercise of its tasks and powers under this Act, ensure an implementation that is identifiable, transparent, and consistent for those subject to supervision.
The supervisor shall, in the exercise of its task, apply a forward-looking and risk-based approach.
In the exercise of its duties, the supervisor shall take into account the consequences that its decisions, particularly in emergency situations, may have for the stability of the financial system of all other Member States involved, based on the information available at the relevant time.
Supervision shall comprise an appropriate combination of off-site activities and on-site inspections.
In aanvulling op artikel 19, eerste lid, van de Kaderwet zelfstandige bestuursorganen draagt de toezichthouder met betrekking tot de uitoefening van zijn taken en bevoegdheden uit hoofde van deze wet zorg voor een voor de onder toezicht staanden kenbare, transparante en consistente uitvoering.
De toezichthouder hanteert bij de uitoefening van zijn taak een vooruitziende en risicogebaseerde benadering.
De toezichthouder neemt bij de uitoefening van zijn taak de gevolgen in overweging die zijn besluiten, met name in noodsituaties, kunnen hebben voor de stabiliteit van het financiële stelsel van alle andere betrokken lidstaten, uitgaande van de op het desbetreffende tijdstip beschikbare informatie.
Het toezicht omvat een passende combinatie van werkzaamheden op afstand en controles ter plaatse.
