The competent actuary who certifies the actuarial report shall be independent of the pension fund and shall perform no other activities for the pension fund.
The certifying actuary is not permitted to perform the activities referred to in Article 147, paragraph 4, for a pension fund if another actuary or another expert belonging to the same organisation as the certifying actuary performs other activities for the same pension fund, unless the organisation of the certifying actuary has a code of conduct approved by the supervisory authority concerning the independence of the certifying actuary.
By way of derogation from the first paragraph, the certifying actuary may perform other activities for the pension fund, insofar as these concern activities of the actuarial function.
De bevoegde actuaris die het actuarieel verslag waarmerkt, is onafhankelijk van het pensioenfonds en verricht geen andere werkzaamheden voor het pensioenfonds.
Het is de waarmerkende actuaris niet toegestaan de werkzaamheden, bedoeld in artikel 147, vierde lid, uit te oefenen voor een pensioenfonds wanneer een andere actuaris of andere deskundige die behoort tot dezelfde organisatie als de waarmerkende actuaris, andere werkzaamheden verricht voor hetzelfde pensioenfonds, tenzij de organisatie van de waarmerkende actuaris een door de toezichthouder goedgekeurde gedragscode heeft over de onafhankelijkheid van de waarmerkende actuaris.
In afwijking van het eerste lid kan de waarmerkende actuaris andere werkzaamheden voor het pensioenfonds verrichten, voor zover het gaat om werkzaamheden van de actuariële functie.
