For each institution or department, there shall be a supervisory committee, the members of which are appointed for a term of five years. They may be eligible for reappointment twice.
The committee shall consist of at least six and at most a number of members to be determined by Our Minister.
The supervisory committee is composed as broadly as possible. Each committee shall in any event include:
a member of the judiciary charged with the administration of justice;
a lawyer;
a medical practitioner;
an expert from the field of social work.
If the committee exercises supervision over an institution or department where medical treatment as referred to in Articles 46a up to and including 46e of the Act is performed, a psychiatrist shall also be a member of the committee.
Bij elke inrichting of afdeling is een commissie van toezicht, waarvan de leden worden benoemd voor de tijd van vijf jaren. Zij kunnen tweemaal voor herbenoeming in aanmerking komen.
De commissie bestaat uit ten minste zes en ten hoogste een door Onze Minister vast te stellen aantal leden.
De commissie van toezicht is zo breed mogelijk samengesteld. Van elke commissie maken in elk geval deel uit:
een met rechtspraak belast lid van de rechterlijke macht;
een advocaat;
een medicus;
een deskundige uit de kring van het maatschappelijk werk.
Indien de commissie toezicht houdt op een inrichting of afdeling waar geneeskundige behandeling als bedoeld in de artikelen 46a tot en met 46e van de wet wordt verricht, maakt ook een psychiater van de commissie deel uit.
