Petitions regarding recovery in law pursuant to this paragraph, as well as petitions for the modification of a judicial recovery order, shall be filed with the court.
Articles 799, paragraph 2, and 801 of the Code of Civil Procedure (Wetboek van Burgerlijke Rechtsvordering) shall apply mutatis mutandis to the filing and consideration of the petition, as well as to the proceedings on appeal.
The municipal executive may, on the basis of this paragraph, act in legal proceedings without a lawyer.
Verzoeken met betrekking tot verhaal in rechte op grond van deze paragraaf, alsmede verzoeken tot wijziging van een rechterlijke verhaalsuitspraak, worden ingediend bij de rechtbank.
Op de indiening en behandeling van het verzoek, alsmede op de procedure in hoger beroep, zijn de artikelen 799, tweede lid, en 801 van het Wetboek van Burgerlijke Rechtsvordering van overeenkomstige toepassing.
Het college kan op grond van deze paragraaf in rechte optreden zonder advocaat.
