The public prosecutor shall, as far as possible, comply with a request from the issuing judicial authority to hear a requested person who has been arrested on the basis of a European arrest warrant issued by that authority for the purposes of a criminal investigation directed against him, prior to his surrender.
The provisions of Articles 5.1.8 and 5.1.9 of the Code of Criminal Procedure and Article 4, paragraphs 1 up to and including 3, of the 2000 EU Convention on Mutual Assistance in Criminal Matters apply to the hearing.
Aan een verzoek van de uitvaardigende justitiële autoriteit om een opgeëiste persoon die op basis van een door hem afgegeven Europees aanhoudingsbevel ten behoeve van een tegen hem gericht strafrechtelijk onderzoek is aangehouden voorafgaand aan diens overlevering te horen, geeft de officier van justitie zo veel mogelijk gevolg.
Op het verhoor zijn de artikelen 5.1.8 en 5.1.9 van het Wetboek van Strafvordering en artikel 4, eerste tot en met derde lid, van de EU-rechtshulpovereenkomst 2000 van toepassing.
