A European arrest warrant shall not be executed in cases where, in the judgment of the court, there are substantial and fact-based grounds to believe that the requested person, upon surrender, faces a real risk that their fundamental rights guaranteed by the Charter of Fundamental Rights of the European Union will be violated.
If there is a possibility that, in the event of a change in circumstances, the real risk of the infringement referred to in the first paragraph may still be excluded, the court shall adjourn the decision on the surrender.
The issuing authority shall be notified of that stay, stating the reasons therefor, and the court shall examine during the stay whether there is any change in circumstances.
If, after application of the third paragraph, the real danger of the infringement referred to in the first paragraph cannot be excluded within a reasonable period, the court shall render a decision as referred to in Article 28, paragraph 3.
Aan een Europees aanhoudingsbevel wordt geen gevolg gegeven in gevallen, waarin naar het oordeel van de rechtbank zwaarwegende en op feiten berustende gronden bestaan dat de opgeëiste persoon na overlevering een reëel gevaar loopt dat zijn door het Handvest van de grondrechten van de Europese Unie gewaarborgde grondrechten zullen worden geschonden.
Indien er een mogelijkheid bestaat dat bij wijziging van de omstandigheden het reële gevaar van de in het eerste lid bedoelde schending alsnog kan worden uitgesloten, dient de rechtbank de beslissing over de overlevering aan te houden.
De uitvaardigende autoriteit wordt onder opgave van redenen van die aanhouding in kennis gesteld en de rechtbank gaat gedurende de aanhouding na of er wijziging in de omstandigheden optreedt.
Indien na toepassing van het derde lid niet binnen een redelijke termijn het reële gevaar van de in het eerste lid bedoelde schending kan worden uitgesloten, doet de rechtbank uitspraak als bedoeld in artikel 28, derde lid.
