The competent authority for the project decision may determine that Article 16.7 applies to the coordination of the decisions for the implementation of the project decision.
Article 16.7 applies to the coordination of decisions for the implementation of project decisions as referred to in Article 5.46.
The competent authority for the project decision shall act as the coordinating administrative body.
By way of derogation from the third paragraph, the coordinating administrative authority shall be:
provincial executive: if the executive board of the water board is authorised to adopt the project decision,
Our Minister concerned: if he is authorised, pursuant to Article 5.44, paragraph 1, or pursuant to Article 5.44a, paragraph 4, to adopt the project decision in agreement with Our Minister of Housing and Spatial Planning.
Het bevoegd gezag voor het projectbesluit kan bepalen dat artikel 16.7 van toepassing is op de coördinatie van de besluiten ter uitvoering van het projectbesluit.
Artikel 16.7 is van toepassing op de coördinatie van besluiten ter uitvoering van projectbesluiten als bedoeld in artikel 5.46.
Als het coördinerend bestuursorgaan treedt het bevoegd gezag voor het projectbesluit op.
In afwijking van het derde lid treden als het coördinerend bestuursorgaan op:
gedeputeerde staten: als het dagelijks bestuur van het waterschap bevoegd is om het projectbesluit vast te stellen,
Onze Minister die het aangaat: als hij op grond van artikel 5.44, eerste lid, of op grond van artikel 5.44a, vierde lid, bevoegd is om het projectbesluit in overeenstemming met Onze Minister van Volkshuisvesting en Ruimtelijke Ordening vast te stellen.
