Article 16.53

When taking a decision as referred to in Article 16.43, paragraph 1, the competent authority shall take into account all consequences that the project to which the decision relates may have for the environment.
The competent authority may:
attach to a decision, notwithstanding the limitations imposed by the statutory regulation upon which the decision is based, such conditions as are necessary for the protection of the environment, including conditions regarding monitoring,
to decide that the project shall not be carried out if the execution of that project may lead to unacceptable consequences for the environment.
A decision taken on the basis of another statutory provision, in the application of the second paragraph, shall be deemed to have been taken on the basis of that provision.
Bij het nemen van een besluit als bedoeld in artikel 16.43, eerste lid, houdt het bevoegd gezag rekening met alle gevolgen die het project, waarop het besluit betrekking heeft, voor het milieu kan hebben.
Het bevoegd gezag kan:
aan een besluit, ongeacht de beperkingen die in de wettelijke regeling waarop het besluit berust, zijn gesteld, de voorschriften verbinden, die nodig zijn voor het beschermen van het milieu, waaronder voorschriften over monitoring,
beslissen dat het project niet wordt uitgevoerd als het uitvoeren van dat project kan leiden tot ontoelaatbare gevolgen voor het milieu.
Een besluit dat op grond van een andere wettelijke regeling wordt genomen, wordt als toepassing aan het tweede lid wordt gegeven, geacht op grond van die regeling te worden genomen.
