The NPO shall make the concession policy plan public.
Our Minister shall request advice from the Commissariaat and the Council for Culture regarding the concession policy plan. In the application of the fourth paragraph, the advice shall be requested after the expiry of the period referred to in that paragraph, under (a). The advice shall in any case relate to the manner in which the pluriformity of the media offering is given shape in the concession policy plan.
The concession policy plan requires the approval of Our Minister insofar as it concerns the subjects referred to in Article 2.20, second paragraph, parts b and c, whereby the approval is granted in accordance with the provisions of the Telecommunications Act.
Insofar as the consent referred to in the third paragraph relates to a new or significantly modified offer channel:
interested parties may, within four weeks after the publication of the concession policy plan, submit their views orally or in writing to Our Minister; and
Our Minister shall request the Authority for Consumers and Markets, upon expiry of the period referred to under (a), to submit a report containing an analysis of the potential effects of the supply channel on the relevant markets.
In the application of the fourth paragraph, the Commissariaat, the Council for Culture and the Authority for Consumers and Markets shall, for the purpose of their advice or reporting, make use of the views referred to in that paragraph, under (a). Our Minister shall provide those views to them.
The Commissariaat may provide the Authority for Consumers and Markets with the data necessary for the analysis referred to in the fourth paragraph, preamble and under (b).
Section 3.4 of the General Administrative Law Act applies to the preparation of a decision regarding consent as referred to in the fourth paragraph.
If the NPO wishes to make amendments to the part of the concession policy plan approved by Our Minister, it shall include these in the budget. The first to seventh paragraphs inclusive shall apply mutatis mutandis.
De NPO maakt het concessiebeleidsplan openbaar.
Over het concessiebeleidsplan vraagt Onze Minister advies aan het Commissariaat en de Raad voor cultuur. Bij toepassing van het vierde lid wordt het advies gevraagd na afloop van de termijn, genoemd in dat lid, onder a. Het advies heeft in elk geval betrekking op de wijze waarop in het concessiebeleidsplan vorm wordt gegeven aan de pluriformiteit van het media-aanbod.
Het concessiebeleidsplan behoeft de instemming van Onze Minister voor zover het betreft de onderwerpen, bedoeld in artikel 2.20, tweede lid, onderdelen b en c, waarbij de instemming geschiedt in overeenstemming met het bepaalde in de Telecommunicatiewet.
Voor zover de instemming, bedoeld in het derde lid, betrekking heeft op een nieuw of significant gewijzigd aanbodkanaal:
kunnen belanghebbenden gedurende vier weken na openbaarmaking van het concessiebeleidsplan mondeling of schriftelijk zienswijzen naar voren brengen bij Onze Minister; en
verzoekt Onze Minister de Autoriteit Consument en Markt na afloop van de termijn, genoemd onder a, een rapportage uit te brengen met een analyse van de mogelijke effecten van het aanbodkanaal op de daarvoor relevante markten.
Bij toepassing van het vierde lid maken het Commissariaat, de Raad voor cultuur en de Autoriteit Consument en Markt ten behoeve van hun adviezen dan wel rapportage gebruik van de zienswijzen, bedoeld in dat lid, onder a. Onze Minister doet die zienswijzen aan hen toekomen.
Het Commissariaat kan de Autoriteit Consument en Markt de gegevens verstrekken die noodzakelijk zijn voor de analyse, bedoeld in het vierde lid, aanhef en onder b.
Op de voorbereiding van een besluit over instemming als bedoeld in het vierde lid is afdeling 3.4 van de Algemene wet bestuursrecht van toepassing.
Als de NPO wijzigingen wil aanbrengen in het door Onze Minister goedgekeurde deel van het concessiebeleidsplan, neemt zij die op in de begroting. Het eerste tot en met zevende lid zijn van overeenkomstige toepassing.
