A natural person or legal person who is requested by an administrative authority to provide data that is available as authentic data in the base register for cadastre or topography pursuant to this Act, is not required to provide that data, except for:
in the event that the annotation "under investigation" has been placed with the relevant authentic data;
in the event of the maintenance or renewal of the cadastral base registration, of land consolidation, re-allotment or reconstruction of an area designated by statutory regulation, of the preparation of land consolidation, re-allotment or reconstruction, or of the maintenance of the topographic base registration;
in the event of the detection or investigation of a violation of a statutory provision or of the monitoring of compliance with a statutory provision;
in the event of a threat of, or the occurrence of, a riotous movement, disturbances, a breach of public order, disasters or serious accidents;
unless otherwise provided by statutory provision, or
in the event that the data is necessary for a proper determination of the identity of the person concerned.
Een natuurlijk persoon of rechtspersoon, aan wie door een bestuursorgaan gevraagd wordt om een gegeven te verstrekken dat krachtens deze wet als authentiek gegeven in de basisregistratie kadaster of topografie beschikbaar is, behoeft dat gegeven niet te verstrekken, behoudens:
ingeval bij het betreffende authentieke gegeven de aantekening «in onderzoek» is geplaatst;
in geval van bijhouding of vernieuwing van de basisregistratie kadaster, van herinrichting, verkaveling of reconstructie van een bij wettelijk voorschrift aangewezen gebied, van voorbereiding van herinrichting, verkaveling of reconstructie of van bijhouding van de basisregistratie topografie;
in geval van opsporing of onderzoek naar overtreding van een wettelijk voorschrift of van controle op de naleving van een wettelijk voorschrift;
in geval van dreiging van, of het zich voordoen van, een oproerige beweging, wanordelijkheden, verstoring van de openbare orde, rampen of zware ongevallen;
ingeval bij wettelijk voorschrift anders is bepaald, of
ingeval het gegeven noodzakelijk is voor een deugdelijke vaststelling van de identiteit van betrokkene.
