The Service is authorised, even without a petition as referred to in Article 66, paragraph 1, to institute an investigation as referred to in Article 67, paragraph 1, if there are reasons to assume that facts have occurred with regard to immovable property as referred to in Articles 29 and 35 of Book 5 of the Civil Code. The Service shall give notice of the intention to conduct an investigation in accordance with Article 57, paragraph 1. Article 57, paragraphs 2 and 3, and Article 67, paragraph 2, shall apply mutatis mutandis.
If the Service has exercised the authority referred to in the previous paragraph and the on-site investigation has given cause for updating, the updating shall take place on the basis of the report of findings. Article 58, paragraphs one and two, shall apply mutatis mutandis.
In the event that the investigation does not give cause for registration, Article 68, paragraph 2, shall apply mutatis mutandis.
De Dienst is bevoegd, ook zonder een verzoek, als bedoeld in artikel 66, eerste lid, een onderzoek, als bedoeld in artikel 67, eerste lid, in te stellen indien er redenen zijn om aan te nemen dat zich met betrekking tot onroerende zaken feiten hebben voorgedaan, als bedoeld in de artikelen 29 en 35 van Boek 5 van het Burgerlijk Wetboek. Van het voornemen tot een onderzoek wordt door de Dienst mededeling gedaan overeenkomstig artikel 57, eerste lid. De artikelen 57, tweede en derde lid, en 67, tweede lid, zijn van overeenkomstige toepassing.
Indien de Dienst gebruik heeft gemaakt van de in het vorige lid bedoelde bevoegdheid en het onderzoek ter plaatse aanleiding heeft gegeven tot bijhouding, vindt bijhouding plaats op grondslag van het relaas van bevindingen. Artikel 58, eerste en tweede lid, is van overeenkomstige toepassing.
Ingeval het onderzoek geen aanleiding geeft tot bijhouding is artikel 68, tweede lid, van overeenkomstige toepassing.
