in forceIn time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed, the States Parties to the present Covenant may take measures derogating from their obligations under the present Covenant to the extent strictly required by the exigencies of the situation, provided that such measures are not inconsistent with their other obligations under international law and do not involve discrimination solely on the ground of race, colour, sex, language, religion or social origin.
On the basis of this provision, no derogation shall be permitted from Articles 6, 7, 8 (first and second paragraph), 11, 15, 16 and 18.
Any State Party to this Convention availing itself of the right of derogation from the provisions thereof shall immediately inform the other States Parties to this Convention, through the intermediary of the Secretary-General of the United Nations, of the provisions from which it has derogated and of the reasons by which it was actuated. A further communication shall be made, likewise through the intermediary of the Secretary-General, on the date on which the derogation ceases to operate.
Bij een algemene noodtoestand, die een bedreiging vormt voor het bestaan van het volk en die officieel is afgekondigd, kunnen de Staten die partij zijn bij dit Verdrag maatregelen nemen, die afwijken van hun verplichtingen ingevolge dit Verdrag, mits deze maatregelen niet verder gaan dan de toestand vereist en niet in strijd zijn met andere verplichtingen welke voortvloeien uit het internationale recht en geen discriminatie uitsluitend op grond van ras, huidskleur, geslacht, taal, godsdienst of maatschappelijke afkomst inhouden.
Op grond van deze bepaling mag niet worden afgeweken van de artikelen 6, 7, 8 (eerste en tweede lid), 11, 15, 16 en 18.
Iedere Staat die partij is bij dit Verdrag die gebruik maakt van het recht tot afwijking van de bepalingen daarvan stelt de andere Staten die partij zijn bij dit Verdrag, door tussenkomst van de Secretaris-Generaal van de Verenigde Naties, onverwijld in kennis van de bepalingen waarvan hij is afgeweken, alsmede van de redenen die hem daartoe hebben genoopt. Eveneens door tussenkomst van de Secretaris-Generaal wordt een volgende kennisgeving gedaan op de datum waarop de afwijking ophoudt van kracht te zijn.
