Obligations for the purpose of recovery

No person may successfully invoke the circumstance that they are bound to secrecy on any grounds whatsoever, even if such obligation has been imposed upon them by a statutory provision, as a justification for a refusal to comply with the obligations described in Articles 58, 59 and 60.

No person may successfully invoke the confidentiality of their contacts with a person entitled to professional privilege (verschoningsgerechtigde) as referred to in Article 63 to refuse to comply with the obligations described in Articles 58 and 60, insofar as it concerns data, information, books, documents, and other data carriers or the content thereof which that person also possesses or can reasonably dispose of without those confidential contacts.

Voor een weigering om te voldoen aan de in de artikelen 58, 59 en 60 omschreven verplichtingen kan niemand zich met vrucht beroepen op de omstandigheid dat hij uit enigerlei hoofde tot geheimhouding verplicht is, zelfs niet indien deze hem bij een wettelijke bepaling is opgelegd.

Voor een weigering om te voldoen aan de in de artikelen 58 en 60 omschreven verplichtingen kan niemand zich met vrucht beroepen op de vertrouwelijkheid van zijn contacten met een verschoningsgerechtigde als bedoeld in artikel 63 voor zover het gegevens, inlichtingen, boeken, bescheiden en andere gegevensdragers of de inhoud daarvan betreft waarover diegene ook zonder die vertrouwelijke contacten beschikt of redelijkerwijs kan beschikken.
