A third party who has the power to dispose of a bank account number to which income tax has been paid out, is jointly and severally liable for the income tax owed by a taxpayer, insofar as the amount of income tax owed has been paid into that bank account. Insofar as an amount of income tax owed arises from the application of Article 15 of the General State Taxes Act (Algemene wet inzake rijksbelastingen), the amount for which the third party is liable shall be determined as the portion of the amount owed by the taxpayer that stands in the same proportion to the amount owed by the taxpayer as the provisional income tax refund paid out to the third party for the tax year stands in proportion to the total amount of provisional income tax refunds paid out for the tax year, all this insofar as this amount can be attributed to the amounts paid out to that third party.

Een derde die kan beschikken over een bankrekeningnummer waarop inkomstenbelasting is uitbetaald, is hoofdelijk aansprakelijk voor de inkomstenbelasting die een belastingschuldige is verschuldigd voor zover het bedrag aan verschuldigde inkomstenbelasting is betaald op die bankrekening. Voor zover een verschuldigd bedrag aan inkomstenbelasting voortvloeit uit de toepassing van artikel 15 van de Algemene wet inzake rijksbelastingen, wordt het bedrag waarvoor de derde aansprakelijk is, bepaald op het gedeelte van het door de belastingschuldige verschuldigde bedrag dat in dezelfde verhouding staat tot het door de belastingschuldige verschuldigde bedrag als de aan de derde over het belastingjaar uitbetaalde voorlopige teruggaaf inkomstenbelasting in verhouding staat tot het totale bedrag van de over het belastingjaar uitbetaalde voorlopige teruggaven inkomstenbelasting, een en ander voor zover dit bedrag kan worden toegerekend aan de aan die derde uitbetaalde bedragen.
