The extent of the protection conferred by a European patent or a European patent application shall be determined by the claims. Nevertheless, the description and drawings shall be used to interpret the claims.
For the period up to grant of the European patent, the extent of the protection conferred by the European patent application shall be determined by the claims contained in the application as published. However, the European patent as granted or as amended in opposition, limitation or revocation proceedings shall determine retroactively the protection conferred by the application, in so far as such protection is not thereby extended.
De beschermingsomvang van het Europees octrooi of van de Europese octrooiaanvrage wordt bepaald door de conclusies. Niettemin dienen de beschrijving en de tekeningen tot uitleg van de conclusies.
Voor het tijdvak tot de verlening van het Europees octrooi wordt de beschermingsomvang van de Europese octrooiaanvrage bepaald door de conclusies die zijn vervat in de gepubliceerde aanvrage. Het Europees octrooi, zoals dit is verleend of gewijzigd tijdens de oppositie-, beperkings- of nietigheidsprocedure, bepaalt echter met terugwerkende kracht de beschermingsomvang die voortvloeit uit de aanvrage, voor zover deze daarbij niet wordt uitgebreid.
