Article 77
in forceFILING OF A EUROPEAN PATENT APPLICATION AND THE REQUIREMENTS TO BE COMPLIED WITH
The central industrial property office of a Contracting State shall forward to the European Patent Office any European patent application filed with it or any other competent authority in that State, in accordance with the Implementing Regulations.
A European patent application the subject of which has been made secret shall not be forwarded to the European Patent Office.
A European patent application not forwarded to the European Patent Office in due time shall be deemed to be withdrawn.
De centrale dienst voor de industriële eigendom van een Verdragsluitende Staat zendt de Europese octrooiaanvragen die bij de dienst of bij een andere bevoegde instantie van die Staat zijn ingediend, door naar het Europees Octrooibureau in overeenstemming met het Uitvoeringsreglement.
Een Europese octrooiaanvrage ten aanzien waarvan is besloten dat het onderwerp onder geheimhouding valt, wordt niet naar het Europees Octrooibureau doorgezonden.
Een Europese octrooiaanvrage die niet tijdig is doorgezonden naar het Europees Octrooibureau wordt geacht te zijn ingetrokken.
