in forceFILING OF A EUROPEAN PATENT APPLICATION AND THE REQUIREMENTS TO BE COMPLIED WITH
The European Patent Office may, in accordance with the Implementing Regulations, invite the applicant to provide information on prior art taken into consideration in national or regional patent proceedings and concerning an invention to which the European patent application relates.
If the applicant fails to reply in due time to an invitation under paragraph 1, the European patent application shall be deemed to be withdrawn.
Het Europees Octrooibureau kan, in overeenstemming met het Uitvoeringsreglement, de aanvrager verzoeken inlichtingen te verstrekken over de stand van de techniek die gehanteerd is bij een nationale of regionale octrooiprocedure en een uitvinding betreft waarop de Europese octrooiaanvrage betrekking heeft.
Indien de aanvrager niet tijdig gevolg geeft aan een verzoek ingevolge het eerste lid, wordt de Europese octrooiaanvrage geacht te zijn ingetrokken.
