The party who is obliged to perform first is nevertheless authorised to suspend the performance of its obligation if, after the conclusion of the contract, circumstances have come to its knowledge which give it good grounds to fear that the other party will not perform its corresponding obligations.
In the event that there are good grounds to fear that performance will be only partial or not proper, the suspension is permitted only in so far as the non-performance justifies it.
De partij die verplicht is het eerst te presteren, is niettemin bevoegd de nakoming van haar verbintenis op te schorten, indien na het sluiten van de overeenkomst te harer kennis gekomen omstandigheden haar goede grond geven te vrezen dat de wederpartij haar daartegenover staande verplichtingen niet zal nakomen.
In geval er goede grond bestaat te vrezen dat slechts gedeeltelijk of niet behoorlijk zal worden nagekomen, is de opschorting slechts toegelaten voor zover de tekortkoming haar rechtvaardigt.
