Upon the transfer of a claim to a new creditor, the latter acquires the accessory rights associated therewith, such as rights of pledge and mortgage and rights arising from a guarantee, privileges, and the power to enforce the enforceable titles existing in respect of the claim and the accessory rights.
Ancillary rights also include the right of the previous creditor to stipulated interest or a penalty or to a periodic penalty payment (dwangsom), except to the extent that the interest was exigible or the penalty or periodic penalty payment had already been forfeited at the time of the transfer.
Bij overgang van een vordering op een nieuwe schuldeiser verkrijgt deze de daarbij behorende nevenrechten, zoals rechten van pand en hypotheek en uit borgtocht, voorrechten en de bevoegdheid om de ter zake van de vordering en de nevenrechten bestaande executoriale titels ten uitvoer te leggen.
Onder de nevenrechten zijn tevens begrepen het recht van de vorige schuldeiser op bedongen rente of boete of op een dwangsom, behalve voor zover de rente opeisbaar of de boete of dwangsom reeds verbeurd was op het tijdstip van de overgang.
