A testamentary disposition that is in conflict with the provisions of Articles 57–61 is voidable. The annulment shall only take place insofar as it is necessary to remedy the prejudice suffered by the person who invokes the ground for annulment.

A decision for the benefit of an intervening person is voidable in the same manner as one for the benefit of the excluded person himself.

3.

The father, the mother, the descendants and the spouse of an excluded person are deemed to be intervening persons, except when they are a relative by blood in the direct line or the spouse of the deceased.

4.

If a legatee is required to provide a counter-performance in connection with a legacy that is voidable pursuant to the preceding paragraphs, Article 54 of Book 3 shall apply mutatis mutandis.

Een uiterste wilsbeschikking die in strijd is met het in de artikelen 57–61 bepaalde, is vernietigbaar. De vernietiging vindt slechts plaats voor zover deze nodig is tot opheffing van het nadeel van degene die zich op de vernietigingsgrond beroept.

Een beschikking ten behoeve van een tussenbeidekomende persoon is op gelijke wijze vernietigbaar als een ten behoeve van de uitgesloten persoon zelf.

De vader, de moeder, de afstammelingen en de echtgenoot van een uitgesloten persoon worden geacht tussenbeidekomende personen te zijn, behalve wanneer zij bloedverwant in de rechte lijn of echtgenoot van de erflater zijn.

4.

Indien een legataris in verband met een krachtens de vorige leden vernietigbaar legaat gehouden is een tegenprestatie te verrichten, is artikel 54 van Boek 3 van overeenkomstige toepassing.
