Whether a spouse, in the event of divorce or legal separation (scheiding van tafel en bed), is entitled to a portion of the pension rights accrued by the other spouse, is governed by the law applicable to the matrimonial property regime of the spouses, subject to Article 1 paragraph 7 of the Act on the Equalisation of Pension Rights in the Event of a Separation.
The preceding paragraph applies to the equalisation of pension rights of spouses who have been legally separated (gescheiden van tafel en bed) after 1 March 2001 or whose marriage has been dissolved after 1 March 2001.
Of een echtgenoot bij echtscheiding of scheiding van tafel en bed recht heeft op een gedeelte van de door de andere echtgenoot opgebouwde pensioenrechten, wordt beheerst door het recht dat van toepassing is op het huwelijksvermogensregime van de echtgenoten, behoudens artikel 1 lid 7 van de Wet verevening pensioenrechten bij scheiding.
Het voorgaande lid is van toepassing op de verevening van pensioenrechten van echtgenoten die na 1 maart 2001 van tafel en bed zijn gescheiden of wier huwelijk na 1 maart 2001 is ontbonden.
