With regard to the application of Article 5 of Book 1, the following applies:
If a child has been validly recognized or legitimated outside the Netherlands, has entered into family law relations with the recognizer through this recognition or legitimation and has thereby acquired or retained Dutch nationality, and if the surname of that child has not been determined with due observance of a choice of name within the meaning of Article 5 paragraph 2 of Book 1, the mother and the recognizer may as yet jointly declare, up to two years after the recognition or the legitimation, which of both their surnames or combination thereof the child shall have. If the child has reached the age of sixteen years at the time of the recognition or the legitimation, then it may as yet itself declare, up to two years after the recognition or the legitimation, which of both parents' surnames or which combination thereof it shall have.
If a child who, during its minority, has been acknowledged by a Dutch national or has become the child of a Dutch national by legitimation without acknowledgment, acquires Dutch nationality by option and, at the time of the option, is in familial legal relations with both its parents, the parents may, on the occasion of the option, jointly declare which of both their surnames or a combination thereof the child shall have. If the child has reached the age of sixteen years at the time of the option, it shall itself declare whether it shall have the surname of one of the parents or a combination thereof.
If a child has acquired Dutch nationality as a result of an adoption pronounced outside the Netherlands and if the surname of that child after the adoption has not been determined with due observance of a choice of name within the meaning of Article 5 paragraph 3 of Book 1, the parents may still, up to two years after the judgment has become final, jointly declare that the child shall have the original surname, either of their surnames or a combination thereof, or either of their surnames in combination with the original surname. If the child has reached the age of sixteen years at the time the judgment becomes final, it may itself still, up to two years after that time, declare whether it shall have the original surname, the surname of one of the parents or a combination thereof, or the surname of one of the parents in combination with the original surname.
The declaration containing the choice of name referred to in Article 5 paragraph 4 of Book 1 may be made prior to the birth of the child if at least one of the parents possesses Dutch nationality at the time of the declaration.
If a child born outside the Netherlands is in a family law relationship with both parents by birth and possesses Dutch nationality, and if the surname of that child in the birth certificate has not been determined with due observance of a choice of name within the meaning of Article 5 paragraph 4 of Book 1, the parents may still jointly declare, up to two years after the birth, which of both their surnames or combination thereof the child shall have.
If the parentage of a child has been validly established outside the Netherlands and that child has thereby acquired or retained Dutch nationality, and if the surname of that child after the establishment of parentage has not been determined with due observance of a choice of name within the meaning of Article 5, paragraph 2, of Book 1 of the Civil Code, the mother and the person whose parentage has been judicially established may still, up to two years after the time at which the judicial decision establishing parentage becomes final, jointly declare which of both their surnames or combination thereof the child shall have. If the child has reached the age of sixteen years at the time at which the decision establishing parentage becomes final, then the child may, up to two years after that time, still declare for himself or herself which of both parents' surnames or which combination thereof he or she shall have.
For the options for choice of name referred to in this paragraph under a - f, it is irrelevant whether the child possesses another nationality in addition to Dutch nationality.
In the case under b, the declaration containing the choice of name is made before the Registrar of Civil Status of the municipality where the option for Dutch nationality is received. In the other cases, the declaration containing the choice of name may be made before any Registrar of Civil Status.
If the child, in addition to Dutch nationality, has one or more other nationalities or will acquire these after registration, the surname may also be chosen that the child could only acquire under the law of another nationality of the child.
Ter zake van de toepassing van artikel 5 van Boek 1 geldt het volgende:
Indien een kind buiten Nederland rechtsgeldig is erkend of gewettigd, door deze erkenning of wettiging in familierechtelijke betrekkingen tot de erkenner is komen te staan en daarbij het Nederlanderschap heeft verkregen of behouden, en indien de geslachtsnaam van dat kind niet is bepaald met inachtneming van een naamskeuze in de zin van artikel 5 lid 2 van Boek 1, kunnen de moeder en de erkenner gezamenlijk alsnog, tot twee jaar na de erkenning of de wettiging, verklaren welke van hun beider geslachtsnamen of combinatie daarvan het kind zal hebben. Heeft het kind op het tijdstip van de erkenning of de wettiging de leeftijd van zestien jaren bereikt, dan kan het, tot twee jaar na de erkenning of de wettiging, zelf alsnog verklaren van wie van beide ouders het de geslachtsnaam of welke combinatie daarvan zal hebben.
Indien een kind dat tijdens zijn minderjarigheid door een Nederlander is erkend of zonder erkenning door wettiging het kind van een Nederlander is geworden, door optie het Nederlanderschap verkrijgt en op het tijdstip van de optie tot zijn beide ouders in familierechtelijke betrekkingen staat, kunnen de ouders ter gelegenheid van de optie gezamenlijk verklaren welke van hun beider geslachtsnamen of combinatie daarvan het kind zal hebben. Heeft het kind op het tijdstip van de optie de leeftijd van zestien jaren bereikt, dan verklaart het zelf of het de geslachtsnaam van een van de ouders of een combinatie daarvan zal hebben.
Indien een kind als gevolg van een buiten Nederland uitgesproken adoptie het Nederlanderschap heeft verkregen en indien de geslachtsnaam van dat kind na de adoptie niet is bepaald met inachtneming van een naamskeuze in de zin van artikel 5 lid 3 van Boek 1, kunnen de ouders alsnog, tot twee jaar nadat de uitspraak in kracht van gewijsde is gegaan, gezamenlijk verklaren dat het kind de oorspronkelijke geslachtsnaam, een van hun beider geslachtsnamen of combinatie daarvan dan wel een van hun beider geslachtsnamen in combinatie met de oorspronkelijke geslachtsnaam zal hebben. Heeft het kind op het tijdstip waarop de uitspraak in kracht van gewijsde gaat de leeftijd van zestien jaren bereikt, dan kan het, tot twee jaar na dat tijdstip, zelf alsnog verklaren of het de oorspronkelijke geslachtsnaam, de geslachtsnaam van een van de ouders of een combinatie daarvan dan wel de geslachtsnaam van een van de ouders in combinatie met de oorspronkelijke geslachtsnaam zal hebben.
De in artikel 5 lid 4 van Boek 1 bedoelde verklaring houdende naamskeuze kan voor de geboorte van het kind worden afgelegd indien ten minste een van de ouders op het tijdstip van de verklaring het Nederlanderschap bezit.
Indien een buiten Nederland geboren kind door geboorte in familierechtelijke betrekking tot de beide ouders staat en het Nederlanderschap bezit, en indien de geslachtsnaam van dat kind in de geboorteakte niet is bepaald met inachtneming van een naamskeuze in de zin van artikel 5 lid 4 van Boek 1, kunnen de ouders gezamenlijk alsnog, tot twee jaar na de geboorte, verklaren welke van hun beider geslachtsnamen of combinatie daarvan het kind zal hebben.
Indien het ouderschap van een kind buiten Nederland rechtsgeldig is vastgesteld en dat kind daardoor het Nederlanderschap heeft verkregen of behouden, en indien de geslachtsnaam van dat kind na de vaststelling van het ouderschap niet is bepaald met inachtneming van een naamskeuze in de zin van artikel 5, tweede lid, van Boek 1 van het Burgerlijk Wetboek, kunnen de moeder en de persoon wiens ouderschap gerechtelijk is vastgesteld alsnog, tot twee jaar na het tijdstip waarop de gerechtelijke beslissing houdende vaststelling van het ouderschap in kracht van gewijsde gaat, gezamenlijk verklaren welke van hun beider geslachtsnamen of combinatie daarvan het kind zal hebben. Heeft het kind op het tijdstip waarop de beslissing houdende vaststelling van het ouderschap in kracht van gewijsde gaat, de leeftijd van zestien jaar bereikt, dan kan het, tot twee jaar na dat tijdstip, zelf alsnog verklaren van wie van beide ouders het de geslachtsnaam of welke combinatie daarvan zal hebben.
Voor de in dit lid onder a – f bedoelde mogelijkheden tot naamskeuze is het onverschillig of het kind naast de Nederlandse nog een andere nationaliteit bezit.
In het geval onder b wordt de verklaring houdende naamskeuze afgelegd ten overstaan van de ambtenaar van de burgerlijke stand van de gemeente waar de optie voor het Nederlanderschap in ontvangst wordt genomen. In de overige gevallen kan de verklaring houdende naamskeuze worden afgelegd ten overstaan van iedere ambtenaar van de burgerlijke stand.
Indien het kind naast de Nederlandse nog een of meer andere nationaliteiten heeft of na registratie zal verkrijgen, kan ook de geslachtsnaam worden gekozen die het kind enkel volgens het recht van een andere nationaliteit van het kind zou kunnen krijgen.
