The Organization is the legal successor to the Benelux Trademark Office, established pursuant to Article 1 of the Benelux Convention on Trademarks of 19 March 1962, and to the Benelux Designs Office, established pursuant to Article 1 of the Benelux Convention on Designs of 25 October 1966. As of the date on which this Convention enters into force, all rights and obligations of the Benelux Trademark Office and the Benelux Designs Office shall be transferred to the Organization.
As of the date of entry into force of this treaty, the Protocol concerning the legal personality of the Benelux Office for Trademarks and of the Benelux Office for Designs or Models of 6 November 1981 is repealed.
De Organisatie is de rechtsopvolger van het Benelux-Merkenbureau, ingesteld ingevolge artikel 1 van het Benelux-Verdrag inzake de warenmerken van 19 maart 1962, en van het Benelux-Bureau voor Tekeningen of Modellen, ingesteld ingevolge artikel 1 van het Benelux-Verdrag inzake tekeningen of modellen van 25 oktober 1966. Op de Organisatie gaan met ingang van de dag waarop dit verdrag in werking treedt, alle rechten en verplichtingen van het Benelux-Merkenbureau en het Benelux-Bureau voor Tekeningen of Modellen over.
Met ingang van de dag van inwerkingtreding van dit verdrag wordt het Protocol betreffende de rechtspersoonlijkheid van het Benelux-Merkenbureau en van het Benelux-Bureau voor tekeningen of modellen van 6 november 1981 ingetrokken.
