1. Member States shall ensure that traders in investment gold keep, as a minimum, accounts of all substantial transactions in investment gold and keep the documents which enable the customers in such transactions to be identified.

Traders shall keep the information referred to in the first subparagraph for a period of at least five years.

2. Member States may accept equivalent obligations under measures adopted pursuant to other Community legislation, such as Directive 2005/60/EC of the European Parliament and of the Council of 26 October 2005 on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing (13), to comply with the requirements under paragraph 1.

3. Member States may lay down obligations which are more stringent, in particular as regards the keeping of special records or special accounting requirements.

1. De lidstaten zorgen ervoor dat handelaren in beleggingsgoud ten minste een boekhouding voeren van alle belangrijke handelingen betreffende beleggingsgoud en de documenten bewaren aan de hand waarvan de identiteit van de afnemer bij dergelijke handelingen kan worden vastgesteld.

De handelaren bewaren de in de eerste alinea bedoelde informatie gedurende ten minste vijf jaar.

2. De lidstaten kunnen evenwaardige verplichtingen uit hoofde van maatregelen vastgesteld krachtens andere communautaire wetgeving, zoals Richtlijn 2005/60/EG van het Europees Parlement en de Raad van 26 oktober 2005 tot voorkoming van het gebruik van het financiële stelsel voor het witwassen van geld en de financiering van terrorisme (15), aanvaarden om aan de vereisten van lid 1 te voldoen.

3. De lidstaten kunnen strengere verplichtingen vaststellen, inzonderheid inzake speciale registratie- of boekhoudingsvereisten.
