Article 7
in forceDNA analysis shall be performed in the laboratory of an institute that has been accredited for this purpose by the Dutch Accreditation Council (Raad voor Accreditatie) in accordance with the requirements specified in NEN-EN ISO/IEC 17025, and which possesses expertise in the field of forensic DNA analysis.
The DNA investigation may be conducted in a laboratory other than the laboratory of the institute if this is necessary due to the capacity of the laboratory of the institute or if the public prosecutor or the examining magistrate, respectively, has ordered that the DNA investigation be conducted in another laboratory.
Only the following shall be eligible as another laboratory as referred to in the second paragraph:
a laboratory that has been accredited by the Dutch Accreditation Council (Raad voor Accreditatie) in accordance with the requirements referred to in NEN-EN ISO/IEC 17 025, and which possesses expertise in the field of forensic DNA analysis, or
a laboratory established abroad, which has been accredited by an institution comparable to the Dutch Accreditation Council (Raad voor Accreditatie) on the basis of requirements comparable to the requirements referred to under (a), and which possesses expertise in the field of forensic DNA analysis.
Pursuant to Article 28, paragraph 1, final sentence, of the Services Act, Section 4.1.3.3 of the General Administrative Law Act does not apply to the application for accreditation referred to in the first and third paragraphs.
If the accreditation of a laboratory as referred to in the first or third paragraph has been revoked, is suspended, or has not been renewed after its expiry date, DNA analysis can no longer be performed in this laboratory.
The DNA investigation referred to in Article 151a, paragraph 6, first sentence, or Article 195b, paragraph 1, first sentence, of the Act shall not be performed by:
the expert who has conducted the DNA investigation as referred to in Article 151a, paragraph 1, first sentence, or Article 195a, paragraph 1, first sentence, of the Act, or
an expert who is affiliated with the same laboratory as the expert referred to under (a).
DNA-onderzoek wordt verricht in het laboratorium van het instituut dat daarvoor door de Raad voor Accreditatie is geaccrediteerd aan de hand van de eisen, genoemd in de NEN-EN ISO/IEC 17 025, genoemd in de NEN-EN ISO/IEC 17 025, en deskundig is op het terrein van forensisch DNA-onderzoek.
Het DNA-onderzoek kan in een ander laboratorium dan het laboratorium van het instituut worden verricht, indien dat vanwege de capaciteit van het laboratorium van het instituut noodzakelijk is of indien de officier van justitie onderscheidenlijk de rechter-commissaris opdracht heeft gegeven dat het DNA-onderzoek in een ander laboratorium wordt verricht.
Als ander laboratorium als bedoeld in het tweede lid komt slechts in aanmerking:
een laboratorium dat door de Raad voor Accreditatie is geaccrediteerd aan de hand van de eisen, genoemd in de NEN-EN ISO/IEC 17 025, genoemd in de NEN-EN ISO/IEC 17 025, en deskundig is op het terrein van forensisch DNA-onderzoek, dan wel
een laboratorium dat gevestigd is in het buitenland, door een met de Raad voor Accreditatie vergelijkbare instantie is geaccrediteerd aan de hand van eisen die vergelijkbaar zijn met de eisen, bedoeld onder a, en deskundig is op het terrein van forensisch DNA-onderzoek.
Met toepassing van artikel 28, eerste lid, laatste zinsnede, van de Dienstenwet is paragraaf 4.1.3.3. van de Algemene wet bestuursrecht niet van toepassing op de aanvraag om accreditatie, bedoeld in het eerste en derde lid.
Indien de accreditatie van een laboratorium als bedoeld in het eerste of derde lid is ingetrokken, is geschorst of na haar vervaldatum niet is verlengd, kan in dit laboratorium niet langer DNA-onderzoek worden verricht.
Het DNA-onderzoek, bedoeld in artikel 151a, zesde lid, eerste volzin, of artikel 195b, eerste lid, eerste volzin, van de wet wordt niet verricht door:
de deskundige die het DNA-onderzoek als bedoeld in artikel 151a, eerste lid, eerste volzin, onderscheidenlijk artikel 195a, eerste lid, eerste volzin, van de wet heeft verricht, dan wel
een deskundige die aan hetzelfde laboratorium is verbonden als de deskundige, bedoeld onder a.
