DNA Testing in Criminal Cases Decree · § 4 · In force since 2020-11-01

1.

There is a DNA database for criminal cases which has the purpose of promoting the prevention, detection, prosecution and trial of criminal offences and the determination of the identity of a corpse.

2.

Our Minister is responsible for the DNA database.

3.

The director of the institute manages the DNA database.

4.

The institute shall record in the DNA database the trace identification number, as referred to in Article 6, paragraph 1, under a, as well as

a.

the corresponding DNA profile of unknown and known deceased victims of crimes as defined in Article 67, paragraph 1, of the Act,

b.

the corresponding DNA profile of persons who are suspected to be missing as a result of criminal offences as defined in Article 67, paragraph 1, of the Act,

c.

the corresponding DNA profile of unknown suspects,

d.

the corresponding DNA profile of suspects in respect of criminal offences as defined in Article 67, paragraph 1, of the Act,

e.

the corresponding DNA profile of former suspects,

f.

the corresponding DNA profile of persons convicted of criminal offences as defined in Article 67, paragraph 1, of the Act, or

g.

the corresponding DNA profile of persons who have fully served their sentence or undergone their measure in respect of criminal offences as defined in Article 67, paragraph 1, of the Act and who have consented in writing to the collection of cellular material for the purpose of determining and processing their DNA profile.

The director of the institute may re-determine the DNA profiles recorded in the DNA database if the state of the art renders this necessary.

The director of the institute may compare the DNA profiles recorded in the DNA database with one another for the purpose referred to in the first paragraph. If the comparison yields a positive result, he shall notify the public prosecutor or the examining magistrate of this result.

By way of derogation from the fourth paragraph, under (a) and (c), the institute shall retain the DNA profile that does not meet the criteria for processing in the DNA database in the file concerning the criminal case in the context of which that DNA profile was determined. The fifth and sixth paragraphs shall apply mutatis mutandis.

8.

By way of derogation from the sixth paragraph, the director may compare the DNA profile of a former suspect, as referred to in the fourth paragraph, under (e), which has been recorded in the DNA database, or the DNA profile of an unknown suspect, as referred to in the fourth paragraph, under (c), which corresponded to that profile in the criminal case in which the former suspect was acquitted or discharged from all legal proceedings, exclusively with each other or with other DNA profiles of unknown suspects, as referred to in the fourth paragraph, under (c), that are related to that criminal case, if

a.

the comparison is made with a view to the revision to the detriment on the ground referred to in Article 482a, paragraph 1, under a, of the Act, and

b.

the examining magistrate, upon the motion of the public prosecutor, has issued an order for the comparison.

9.

In the event of the application of the eighth paragraph, the examining magistrate who issued the order for the comparison shall, as soon as the interests of the investigation permit, notify the former suspect in writing of the result of the investigation.

The director of the institute may compare the DNA profiles of the persons who are provided to Our Minister pursuant to Article 4:2, first paragraph, under k, sub-item 3°, of the Police Data Decree (Besluit politiegegevens), with the DNA profiles of the persons referred to in the fourth paragraph, under d, f and g. If the comparison yields a positive result, he shall notify the public prosecutor or the examining magistrate and a national unit as referred to in Article 25, first paragraph, under b, of the Police Act 2012 (Politiewet 2012) of this result.

Er is een DNA-databank voor strafzaken die tot doel heeft het voorkomen, opsporen, vervolgen en berechten van strafbare feiten en het vaststellen van de identiteit van een lijk te bevorderen.

Onze Minister is voor de DNA-databank verantwoordelijk.

3.

De directeur van het instituut voert het beheer over de DNA-databank.

Het instituut legt in de DNA-databank het sporenidentificatienummer, bedoeld in artikel 6, eerste lid, onder a, vast, alsmede

a.

het bijbehorende DNA-profiel van onbekende en bekende overleden slachtoffers van misdrijven als omschreven in artikel 67, eerste lid, van de wet,

b.

het bijbehorende DNA-profiel van personen van wie vermoed wordt dat zij als gevolg van misdrijven als omschreven in artikel 67, eerste lid, van de wet, vermist zijn,

c.

het bijbehorende DNA-profiel van onbekende verdachten,

d.

het bijbehorende DNA-profiel van verdachten ter zake van misdrijven als omschreven in artikel 67, eerste lid, van de wet,

e.

het bijbehorende DNA-profiel van gewezen verdachten,

f.

het bijbehorende DNA-profiel van veroordeelden ter zake van misdrijven als omschreven in artikel 67, eerste lid, van de wet, dan wel

g.

het bijbehorende DNA-profiel van personen die hun straf of maatregel volledig hebben ondergaan ter zake van misdrijven als omschreven in artikel 67, eerste lid, van de wet en die schriftelijk hebben toegestemd in het afnemen van celmateriaal ten behoeve van het bepalen en verwerken van hun DNA-profiel.

De directeur van het instituut kan de DNA-profielen die in de DNA-databank zijn vastgelegd, opnieuw bepalen indien de stand van de techniek dat noodzakelijk maakt.

De directeur van het instituut kan de DNA-profielen die in de DNA-databank zijn vastgelegd, onderling vergelijken met het oog op het doel, bedoeld in het eerste lid. Indien de vergelijking een positief resultaat heeft, stelt hij de officier van justitie of de rechter-commissaris van dit resultaat in kennis.

In afwijking van het vierde lid, onder a en c, bewaart het instituut het DNA-profiel dat niet voldoet aan de criteria voor verwerking in de DNA-databank, in het dossier over de strafzaak in het kader waarvan dat DNA-profiel is bepaald. Het vijfde en zesde lid zijn van overeenkomstige toepassing.

In afwijking van het zesde lid kan de directeur het DNA-profiel van een gewezen verdachte, bedoeld in het vierde lid, onder e, dat in de DNA-databank is vastgelegd of het DNA-profiel van een onbekende verdachte, bedoeld in het vierde lid, onder c, dat in de strafzaak waarin de gewezen verdachte is vrijgesproken of ontslagen van alle rechtsvervolging, met dat profiel overeenkwam, uitsluitend onderling of met andere met die strafzaak in verband staande DNA-profielen van onbekende verdachten als bedoeld in het vierde lid, onder c, vergelijken indien

a.

de vergelijking plaatsvindt met het oog op de herziening ten nadele op de in artikel 482a, eerste lid, onder a, van de wet bedoelde grond, en

b.

de rechter-commissaris, op vordering van de officier van justitie, opdracht tot de vergelijking heeft gegeven.

9.

In geval van toepassing van het achtste lid geeft de rechter-commissaris die de opdracht tot de vergelijking heeft gegeven, de gewezen verdachte, zodra het belang van het onderzoek dat toelaat, schriftelijk kennis van de uitslag van het onderzoek.

10.

De directeur van het instituut kan de DNA-profielen van de personen die ingevolge artikel 4:2, eerste lid, onder k, onderdeel 3°, van het Besluit politiegegevens aan Onze Minister worden verstrekt, vergelijken met de DNA-profielen van de personen, bedoeld in het vierde lid, onder d, f en g. Indien de vergelijking een positief resultaat heeft, stelt hij de officier van justitie of de rechter-commissaris en een landelijke eenheid als bedoeld in artikel 25, eerste lid, onder b, van de Politiewet 2012 van dit resultaat in kennis.
