A notification within the meaning of Article 8 of the Act is valid for a duration of one year for:
a service provider established abroad, who:
has at least 1 and at most 9 employees in service;
is established within a radius of 100 kilometres from the Dutch border;
is registered in the Commercial Register, as referred to in Article 2 of the Commercial Register Act 2007, or a comparable register in adjacent countries;
has performed at least 3 transnational services in the Netherlands in the preceding calendar year, or has submitted a notification as referred to in this article in the preceding calendar year; and
is not active in a sector that is classified in the Standard Industrial Classification (Standaard Bedrijfsindeling) under:
Section F Construction industry; or
Section 78 Employment mediation, temporary employment agencies and personnel management;
a self-employed person established abroad, who:
is employed in a sector of professional or business life as referred to in Article 8, paragraph 1;
is established within a radius of 100 kilometres from the Dutch border;
is registered in the commercial register, as referred to in Article 2 of the Commercial Register Act 2007, or a comparable register in adjacent countries;
has performed at least 3 transnational services in the Netherlands in the preceding calendar year, or has submitted a notification as referred to in this article in the preceding calendar year; and
is not active in the sector classified under section F Construction (Bouwnijverheid) in the Standard Industrial Classification (Standaard Bedrijfsindeling);
a service provider who, in the context of the cross-border provision of services, makes their employee available in the goods transport sector and to whom neither Article 9e nor Article 9g of the Act applies, or a self-employed person established abroad who is active in the sector classified in the Standard Industrial Classification (Standaard Bedrijfsindeling) under group 49.4 Road transport of goods, including the self-employed person who delivers goods in the Netherlands on behalf of a service recipient established in the Netherlands.
Een melding in de zin van artikel 8 van de wet is geldig voor de duur van een jaar voor:
een in het buitenland gevestigde dienstverrichter, die:
ten minste 1 en ten hoogste 9 werknemers in dienst heeft;
is gevestigd binnen een straal van 100 kilometer van de Nederlandse grens;
is ingeschreven in het handelsregister, bedoeld in artikel 2 van de Handelsregisterwet 2007, of een vergelijkbaar register in aangrenzende landen;
in het voorafgaande kalenderjaar ten minste 3 transnationale diensten in Nederland heeft verricht, dan wel in het voorafgaande kalenderjaar een melding als bedoeld in dit artikel heeft verricht; en
niet werkzaam is in een sector die in de Standaard Bedrijfsindeling is ingedeeld in:
de sectie F Bouwnijverheid; of
de afdeling 78 Arbeidsbemiddeling, uitzendbureaus en personeelsbeheer;
een in het buitenland gevestigde zelfstandige, die:
werkzaam is in een in artikel 8, eerste lid, genoemde sector van het beroeps- of bedrijfsleven;
is gevestigd binnen een straal van 100 kilometer van de Nederlandse grens;
is ingeschreven in het handelsregister, bedoeld in artikel 2 van de Handelsregisterwet 2007, of een vergelijkbaar register in aangrenzende landen;
in het voorafgaande kalenderjaar ten minste 3 transnationale diensten in Nederland heeft verricht, dan wel in het voorafgaande kalenderjaar een melding als bedoeld in dit artikel heeft verricht; en
niet werkzaam is in de sector die in de Standaard Bedrijfsindeling is ingedeeld in de sectie F Bouwnijverheid;
een dienstverrichter die in het kader van transnationale dienstverrichting zijn werknemer ter beschikking stelt in de sector goederenvervoer en op wie zowel artikel 9e als artikel 9g van de wet niet van toepassing is, of een in het buitenland gevestigde zelfstandige die werkzaam is in de sector die in de Standaard Bedrijfsindeling is ingedeeld in de groep 49.4 Goederenvervoer over de weg, met inbegrip van de zelfstandige die in Nederland in opdracht van een in Nederland gevestigde dienstontvanger goederen levert.
