in forceThis Act shall, as regards the relations between the countries of the Union, and to the extent that it applies, replace the Berne Convention of September 9, 1886, and the subsequent Acts of revision. The Acts previously in force shall continue to be applicable, in their entirety or to the extent that this Act does not replace them by virtue of the preceding sentence, in relations with countries of the Union which do not ratify or accede to this Act.
Countries outside the Union which become party to this Act shall, subject to paragraph (3), apply it with respect to any country of the Union not bound by this Act or which, although bound by this Act, has made a declaration pursuant to Article 28 (1) (b). Such countries recognize that the said country of the Union, in its relations with them:
may apply the provisions of the most recent Act by which it is bound, and
subject to Article I (6) of the Appendix, has the right to adapt the protection to the level provided for by this Act.
Any country which has availed itself of any of the faculties provided for in the Appendix may apply the provisions of the Appendix relating to the faculty or faculties of which it has availed itself in its relations with any other country of the Union which is not bound by this Act, provided that the latter country has accepted the application of the said provisions.
Deze Akte vervangt in de betrekkingen tussen de landen van de Unie en voor zover zij van toepassing is, de Berner Conventie van 9 september 1886 en de daarop gevolgde Akten van herziening. De Akten die tevoren van kracht waren, blijven in hun geheel of voor zover deze Akte daarvoor niet in de plaats treedt krachtens de voorgaande zin, van toepassing in de betrekkingen met de landen van de Unie die deze Akte niet bekrachtigen of daartoe niet toetreden.
Landen die geen lid van de Unie zijn en partij worden bij deze Akte, passen haar, onder voorbehoud van het bepaalde in het derde lid, toe ten aanzien van elk land van de Unie dat niet is gebonden door deze Akte of dat, daardoor gebonden zijnde, de verklaring bedoeld in artikel 28, eerste lid, letter b, heeft afgelegd. Deze landen stemmen ermede in dat het bedoelde land van de Unie in zijn betrekkingen met hen:
de bepalingen toepast van de meest recente Akte waardoor het gebonden is, en
behoudens het bepaalde in artikel I, zesde lid, van het Aanhangsel de bevoegdheid heeft de bescherming aan het niveau voorzien in deze Akte, aan te passen.
Een land dat gebruik heeft gemaakt van een van de mogelijkheden voorzien in het Aanhangsel, kan de bepalingen van het Aanhangsel die betrekking hebben op die mogelijkheid of mogelijkheden waarvan het gebruik heeft gemaakt inroepen in zijn betrekkingen met elk ander land van de Unie dat niet gebonden is door deze Akte, mits laatstgenoemd land de toepassing van deze bepalingen heeft aanvaard.
