Article 28
in forceAny country of the Union which has signed this Act may ratify it, and, if it has not signed it, may accede to it. Instruments of ratification or accession shall be deposited with the Director General.
Any country of the Union may declare in its instrument of ratification or accession that its ratification or accession shall not apply to Articles 1 to 21 and the Appendix, provided that, if such country has previously made a declaration under Article VI (1) of the Appendix, then it may declare in the said instrument only that its ratification or accession shall not apply to Articles 1 to 20.
Any country of the Union which, in accordance with subparagraph (b) , has excluded provisions therein referred to from the effects of its ratification or accession may at any later time declare that it extends the effects of its ratification or accession to those provisions. Such declaration shall be deposited with the Director General.
Articles 1 to 21 and the Appendix shall enter into force three months after both of the following two conditions are fulfilled:
at least five countries of the Union have ratified or acceded to this Act without making a declaration under paragraph (1)(b),
France, Spain, the United Kingdom of Great Britain and Northern Ireland, and the United States of America, have become bound by the Universal Copyright Convention as revised at Paris on July 24, 1971.
The entry into force referred to in subparagraph (a) shall apply to those countries of the Union which, at least three months before the said entry into force, have deposited instruments of ratification or accession not containing a declaration under paragraph (1) (b).
With respect to any country of the Union not covered by subparagraph (b) and which ratifies or accedes to this Act without making a declaration under paragraph (1) (b), Articles 1 to 21 and the Appendix shall enter into force three months after the date on which the Director General has notified the deposit of the relevant instrument of ratification or accession, unless a subsequent date has been indicated in the instrument deposited. In the latter case, Articles 1 to 21 and the Appendix shall enter into force with respect to that country on the date thus indicated.
The provisions of subparagraphs (a) to (c) do not affect the application of Article VI of the Appendix.
With respect to any country of the Union which ratifies or accedes to this Act with or without a declaration made under paragraph (1) (b), Articles 22 to 38 shall enter into force three months after the date on which the Director General has notified the deposit of the relevant instrument of ratification or accession, unless a subsequent date has been indicated in the instrument deposited. In the latter case, Articles 22 to 38 shall enter into force with respect to that country on the date thus indicated.
Elk land van de Unie dat deze akte heeft ondertekend kan haar bekrachtigen en, zo het deze niet heeft ondertekend, daartoe toetreden. De akten van bekrachtiging en toetreding worden nedergelegd bij de Directeur-Generaal.
Elk land van de Unie kan in zijn akte van bekrachtiging of toetreding verklaren dat zijn bekrachtiging of toetreding niet geldt ten aanzien van de artikelen 1 tot en met 21 en het Aanhangsel; indien dit land evenwel reeds een verklaring ingevolge artikel VI, eerste lid, van het Aanhangsel heeft afgelegd, kan het in genoemde akte verklaren dat zijn bekrachtiging of toetreding niet geldt ten aanzien van de artikelen 1 tot en met 20.
Elk land van de Unie dat overeenkomstig het bapaalde onder letter b de onder die letter genoemde bepalingen heeft uitgesloten van zijn bekrachtiging of toetreding, kan op elk later tijdstip verklaren dat zijn bekrachtiging of toetreding zich uitstrekt tot deze artikelen. Een zodanige verklaring wordt nedergelegd bij de Directeur-Generaal.
De artikelen 1 tot en met 21 en het Aanhangsel treden in werking drie maanden nadat aan de beide onderstaande voorwaarden is voldaan:
tenminste vijf landen van de Unie hebben deze Akte bekrachtigd of zijn daartoe toegetreden zonder aflegging van een verklaring zoals bedoeld in het eerste lid, letter b,
Frankrijk, Spanje, de Verenigde Staten van Amerika en het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland zijn gebonden door de Universele Auteursrechtconventie, zoals herzien te Parijs op 24 juli 1971.
De inwerkingtreding bedoeld in letter a wordt van kracht door de landen van de Unie die ten minste drie maanden voor genoemde inwerkingtreding akten van bekrachtiging of toetreding hebben nedergelegd die geen verklaring zoals bedoeld in het eerste lid, letter b, bevatten,
Voor elk land van de Unie waarop letter b niet van toepassing is en dat deze Akte bekrachtigt of daartoe toetreedt zonder aflegging van een verklaring ingevolge het eerste lid, letter b, treden de artikelen 1 tot en met 21 en het Aanhangsel in werking drie maanden na de datum waarop de Directeur-Generaal kennis heeft gegeven van de nederlegging van de betrokken akte van bekrachtiging of toetreding, tenzij in de nedergelegde akte een latere datum is aangegeven. In dat geval treden de artikelen 1 tot en met 21 en het Aanhangsel voor dat land in werking op de aldus aangegeven datum.
De bepalingen van de letters a tot en met c laten de toepassing van artikel VI van het Aanhangsel onverlet.
Voor elk land van de Unie dat deze Akte bekrachtigt of daartoe toetreedt met of zonder verklaring ingevolge het eerste lid, letter b, treden de artikelen 22 tot en met 38 in werking drie maanden na de datum waarop de Directeur-Generaal kennis heeft gegeven van de nederlegging van de betrokken akte van bekrachtging of toetreding, tenzij in de nedergelegde akte een latere datum is aangegeven. In dat geval treden de artikelen 22 tot en met 38 voor dat land in werking op de aldus aangegeven datum.
