in forceThe Union shall have a budget.
The budget of the Union shall include the income and expenses proper to the Union, its contribution to the budget of expenses common to the Unions, and, where applicable, the sum made available to the budget of the Conference of the Organization.
Expenses not attributable exclusively to the Union but also to one or more other Unions administered by the Organization shall be considered as expenses common to the Unions. The share of the Union in such common expenses shall be in proportion to the interest the Union has in them.
The budget of the Union shall be established with due regard to the requirements of coordination with the budgets of the other Unions administered by the Organization.
The budget of the Union shall be financed from the following sources:
contributions of the countries of the Union;
fees and charges due for services performed by the International Bureau in relation to the Union;
sale of, or royalties on, the publications of the International Bureau concerning the Union;
gifts, bequests, and subventions;
rents, interests, and other miscellaneous income.
For the purpose of establishing its contribution towards the budget, each country of the Union shall belong to a class, and shall pay its annual contributions on the basis of a number of units fixed as follows:
Unless it has already done so, each country shall indicate concurrently with depositing its instrument of ratification or accession, the class to which it wishes to belong. Any country may change class. If it chooses a lower class, the country must announce it to the Assembly at one of its ordinary sessions. Any such change shall take effect at the beginning of the calendar year following the session.
The annual contribution of each country shall be an amount in the same proportion to the total sum to be contributed to the annual budget of the Union by all countries as the number of its units is to the total of the units of all contributing countries.
Contributions shall become due on the first of January of each year.
A country which is in arrears in the payment of its contributions shall have no vote in any of the organs of the Union of which it is a member if the amount of its arrears equals or exceeds the amount of the contributions due from it for the preceding two full years. However, any organ of the Union may allow such a country to continue to exercise its vote in that organ if, and as long as, it is satisfied that the delay in payment is due to exceptional and unavoidable circumstances.
If the budget is not adopted before the beginning of a new financial period, it shall be at the same level as the budget of the previous year, in accordance with the financial regulations.
The amount of the fees and charges due for services rendered by the International Bureau in relation to the Union shall be established, and shall be reported to the Assembly and the Executive Committee, by the Director General.
The Union shall have a working capital fund which shall be constituted by a single payment made by each country of the Union. If the fund becomes insufficient, an increase shall be decided by the Assembly.
The amount of the initial payment of each country to the said fund or of its participation in the increase thereof shall be a proportion of the contribution of that country for the year in which the fund is established or the increase decided.
The proportion and the terms of payment shall be fixed by the Assembly on the proposal of the Director General and after it has heard the advice of the Coordination Committee of the Organization.
In the headquarters agreement concluded with the country on the territory of which the Organization has its headquarters, it shall be provided that, whenever the working capital fund is insufficient, such country shall grant advances. The amount of these advances and the conditions on which they are granted shall be the subject of separate agreements, in each case, between such country and the Organization. As long as it remains under the obligation to grant advances, such country shall have an ex officio seat on the Executive Committee.
The country referred to in subparagraph (a) and the Organization shall each have the right to denounce the obligation to grant advances, by written notification. Denunciation shall take effect three years after the end of the year in which it has been notified.
The auditing of the accounts shall be effected by one or more of the countries of the Union or by external auditors, as provided in the financial regulations. They shall be designated, with their agreement, by the Assembly.
De Unie heeft een begroting.
De begroting van de Unie omvat de eigen inkomsten en uitgaven van de Unie, haar bijdragen aan de begroting van de gemeenschappelijke uitgaven der Unies, alsook, indien zulks zich voordoet, het bedrag dat ter beschikking is gesteld van de begroting van de Conferentie der Organisatie.
Als gemeenschappelijke uitgaven der Unies worden beschouwd de uitgaven die niet uitsluitend ten laste van de Unie komen maar tevens van een of meer andere Unies, welke worden beheerd door de Organisatie. Het aandeel van de Unie in deze gemeenschappelijke uitgaven is evenredig aan het belang, dat deze uitgaven voor haar vertegenwoordigen.
De begroting van de Unie wordt vastgesteld met inachtneming van de vereisten tot coördinatie met de begrotingen van de andere door de Organisatie beheerde Unies.
De begroting van de Unie wordt gefinancierd uit de volgende bronnen van inkomsten:
de bijdragen van de landen van de Unie;
de taksen en gelden verschuldigd voor diensten verleend door het Internationale Bureau met betrekking tot de Unie;
de opbrengst van de verkoop van de publikaties van het Internationale Bureau betreffende de Unie en de rechten welke op deze publikaties betrekking hebben;
giften, legaten en subsidies;
huuropbrengsten, renten en overige inkomsten.
Ter vaststelling van zijn bijdragen aan de begroting behoort ieder land van de Unie tot een klasse en betaalt het zijn jaarlijkse bijdragen op basis van een als volgt vastgesteld aantal eenheden:
Tenzij het zulks reeds eerder heeft gedaan, geeft elk land op het tijdstip van nederlegging van zijn akte van bekrachtiging of toetreding de klasse aan waartoe het wenst te behoren. Het kan van klasse veranderen. Indien het een lagere klasse kiest, moet het de Algemene Vergadering tijdens een gewone zitting hiervan in kennis stellen. Een dergelijke verandering gaat in bij het begin van het kalenderjaar volgend op dat van genoemde zitting.
De jaarlijkse bijdrage van elk land wordt gevormd door een bedrag, waarvan de verhouding tot de som van de jaarlijkse bijdragen van alle landen aan de begroting van de Unie dezelfde is als de verhouding tussen het aantal eenheden van de klasse waarin het is ondergebracht en het totale aantal eenheden van de landen gezamenlijk.
De bijdragen zijn ieder jaar op 1 januari verschuldigd.
Een land, dat achterstallig is niet de betaling van zijn bijdragen kan in geen der organen van de Unie waarvan het lid is zijn stem recht uitoefenen, indien het bedrag van zijn achterstalligheid gelijk is aan of hoger is dan dat der bijdragen, verschuldigd over twee voorafgaande volle jaren. Het kan dat land evenwel vergund worden de uitoefening van zijn stemrecht in het desbetreffende orgaan te behouden, zolang dit orgaan van oordeel is dat de achterstalligheid wordt veroorzaakt door uitzonderlijke en onvermijdelijke omstandigheden.
Ingeval een begroting niet is vastgesteld voor de aanvang van het nieuwe begrotingsjaar wordt de begroting van het voorafgaande jaar aangehouden volgens de werkwijze voorzien in het financieel reglement.
Het bedrag der taksen en der gelden verschuldigd voor door het Internationale Bureau met betrekking tot de Unie verleende diensten wordt vastgesteld door de Directeur-Generaal, die daarover verslag uitbrengt aan de Algemene Vergadering en de Uitvoerende Commissie.
De Unie bezit een operationeel fonds, dat gevormd wordt door een eenmalige storting van elk der landen van de Unie. Indien het fonds ontoereikend blijkt, beslist de Algemene Vergadering tot bij storting.
Het bedrag der eerste storting door ieder land aan het hiervoor vermelde fonds of van zijn deelneming aan de bijstorting is evenredig aan de bijdrage van dat land voor het jaar waarin het fonds is gesticht of tot bijstorting is besloten.
Het aandeel en de wijze van storting worden vastgesteld door de Algemene Vergadering op voorstel van de Directeur-Generaal en na ingewonnen advies van de Coördinatiecommissie van de Organisatie.
De zetelovereenkomst gesloten met het land op welks grondgebied de Organisatie haar zetel heeft, bepaalt dat, indien het operationeel fonds niet toereikend is, dat land voorschotten verstrekt. Het bedrag van deze voorschotten en de voorwaarden waaronder zij worden verstrekt, vormen telkenmale het onderwerp van afzonderlijke overeenkomsten tussen het betrokken land en de Organisatie. Zolang dit land gehouden is voorschotten te verstrekken beschikt het van rechtswege over een zetel in de Uitvoerende Commissie.
Het land bedoeld onder letter a en de Organisatie hebben elk het recht de overeenkomst tot het verstrekken van voorschotten schriftelijk op te zeggen. De opzegging wordt van kracht drie jaar na afloop van het jaar waarin de kennisgeving is gedaan.
Het nazien der rekeningen wordt verricht, op de wijze voorzien in het financiële reglement, door een of meer landen van de Unie of door onafhankelijke controleurs, die, met hun instemming, zijn aangewezen door de Algemene Vergadering.
