The person in care shall lodge a complaint by submitting a written complaint to the secretary of the complaints committee of the institution where the decision complained of was taken.
The submission of the petition may be effected through the intervention of the head of the institution where the person under treatment resides. In that case, the head of the institution shall ensure that the petition, or, if the petition is contained in a sealed envelope, the envelope, is provided with a date.
The petition (application) shall state as precisely as possible the decision against which the complaint is directed and the grounds for the complaint. If the person under treatment has not submitted a request for mediation regarding the decision against which he complains, he shall state the reasons for this in the petition (application).
If the person under care does not have a sufficient command of the Dutch language, they may submit the complaint in another language. The chair of the complaints committee may determine that the complaint shall be translated into the Dutch language. The reimbursement of the costs incurred for the translation shall be effected in accordance with rules to be established by Order in Council.
The complaint must be submitted no later than the seventh day following the day on which the person in care has become aware of the decision against which they wish to lodge a complaint. The day on which the complaint is submitted shall be the day of receipt by the secretary or the date referred to in the second paragraph. A complaint submitted after the expiry of this period shall nevertheless be admissible if it cannot reasonably be held that the person in care has been in default.
In the event that the patient has submitted a petition for mediation regarding the contested decision, then, notwithstanding the provisions of the fifth paragraph, the statement of complaint must be submitted no later than the seventh day following the day on which the patient received the written notification of the findings of the supervisory committee.
De verpleegde doet beklag door de indiening van een klaagschrift bij de secretaris van de beklagcommissie van de instelling waar de beslissing waarover hij klaagt is genomen.
De indiening van het klaagschrift kan door tussenkomst van het hoofd van de instelling waar de verpleegde verblijft geschieden. Het hoofd van de instelling draagt in dat geval zorg dat het klaagschrift, of, indien het klaagschrift zich in een gesloten envelop bevindt de envelop, van een dagtekening wordt voorzien.
Het klaagschrift vermeldt zo nauwkeurig mogelijk de beslissing waarover wordt geklaagd en de redenen van het beklag. Indien de verpleegde omtrent de beslissing waarover hij klaagt geen verzoek tot bemiddeling heeft gedaan, vermeldt hij de redenen hiervoor in het klaagschrift.
Indien de verpleegde de Nederlandse taal niet voldoende beheerst, kan hij het klaagschrift in een andere taal indienen. De voorzitter van de beklagcommissie kan bepalen dat het klaagschrift in de Nederlandse taal wordt vertaald. De vergoeding van de voor de vertaling gemaakte kosten geschiedt volgens regelen te stellen bij algemene maatregel van bestuur
Het klaagschrift moet uiterlijk op de zevende dag na die waarop de verpleegde kennis heeft gekregen van de beslissing waarover hij zich wenst te beklagen worden ingediend. Als dag waarop het klaagschrift is ingediend, geldt die van de ontvangst door de secretaris dan wel de dagtekening, bedoeld in het tweede lid. Een na afloop van deze termijn ingediend klaagschrift is niettemin ontvankelijk, indien redelijkerwijs niet kan worden geoordeeld dat de verpleegde in verzuim is geweest.
Ingeval de verpleegde een verzoek tot bemiddeling inzake de bestreden beslissing heeft gedaan, dan moet, in afwijking van het bepaalde in het vijfde lid, het klaagschrift worden ingediend uiterlijk op de zevende dag na die waarop de verpleegde de schriftelijke mededeling van de bevindingen van de commissie van toezicht heeft ontvangen.
