The head of the institution may grant permission for a conversation to be held between the person being nursed and a representative of the media, insofar as this is compatible with the following interests:
the protection of society against the danger posed by the person being nursed to the safety of others than the person being nursed or the general safety of persons or property;
the maintenance of order or safety within the institution;
the protection of public order and public morality;
the protection of the rights and freedoms of others than the person being cared for;
the prevention or investigation of criminal offences.
The head of the institution may attach conditions to the access of a media representative to the institution with a view to protecting the interests referred to in the first paragraph. The head of the institution is authorised to have a media representative removed from the institution if he fails to comply with the conditions imposed upon him.
The head of the institution may supervise contact with a media representative if this is necessary with a view to an interest as referred to in the second paragraph. Article 37, fourth paragraph, second and third sentences, and fifth paragraph shall apply mutatis mutandis.
Het hoofd van de instelling kan toestemming geven voor het voeren van een gesprek tussen de verpleegde en een vertegenwoordiger van de media, voor zover dit zich verdraagt met de volgende belangen:
de bescherming van de maatschappij tegen de gevaarlijkheid van de verpleegde voor de veiligheid van anderen dan de verpleegde of de algemene veiligheid van personen of goederen;
de handhaving van de orde of de veiligheid in de instelling;
de bescherming van de openbare orde en de goede zeden;
de bescherming van de rechten en vrijheden van anderen dan de verpleegde;
de voorkoming of opsporing van strafbare feiten.
Het hoofd van de instelling kan met het oog op de bescherming van de in het eerste lid genoemde belangen aan de toegang van een vertegenwoordiger van de media tot de instelling voorwaarden verbinden. Het hoofd van de instelling is bevoegd een vertegenwoordiger van de media uit de instelling te doen verwijderen, indien hij de hem opgelegde voorwaarden niet nakomt.
Het hoofd van de instelling kan op het contact met een vertegenwoordiger van de media toezicht uitoefenen, indien dit noodzakelijk is met het oog op een belang als bedoeld in het tweede lid. Artikel 37, vierde lid, tweede en derde volzin, en vijfde lid is van overeenkomstige toepassing.
