This article applies if an advisory committee has been established for the purpose of the decision on the objection:
which consists of a chairperson and at least two members,
of which the chair does not form part of and is not employed under the responsibility of the administrative authority and
which meets any other requirements laid down by statutory regulation.
If a committee will advise on the objection, the administrative authority shall communicate this as soon as possible to the submitter of the notice of objection.
The hearing shall be conducted by the committee. The committee may entrust the hearing to the chairperson or a member who does not form part of and does not work under the responsibility of the administrative authority.
The committee decides on the application of Article 7:4, paragraph 6, of Article 7:5, paragraph 2, and, insofar as not otherwise provided by statutory provision, of Article 7:3.
A representative of the administrative authority is invited to the hearing and is given the opportunity to provide an explanation of the position of the administrative authority.
The advice of the committee is issued in writing and contains a report of the hearing.
If the decision on the objection deviates from the advice of the committee, the reason for that deviation shall be stated in the decision and the advice shall be sent together with the decision.
Dit artikel is van toepassing indien ten behoeve van de beslissing op het bezwaar een adviescommissie is ingesteld:
die bestaat uit een voorzitter en ten minste twee leden,
waarvan de voorzitter geen deel uitmaakt van en niet werkzaam is onder verantwoordelijkheid van het bestuursorgaan en
die voldoet aan eventueel bij wettelijk voorschrift gestelde andere eisen.
Indien een commissie over het bezwaar zal adviseren, deelt het bestuursorgaan dit zo spoedig mogelijk mede aan de indiener van het bezwaarschrift.
Het horen geschiedt door de commissie. De commissie kan het horen opdragen aan de voorzitter of een lid dat geen deel uitmaakt van en niet werkzaam is onder verantwoordelijkheid van het bestuursorgaan.
De commissie beslist over de toepassing van artikel 7:4, zesde lid, van artikel 7:5, tweede lid, en, voor zover bij wettelijk voorschrift niet anders is bepaald, van artikel 7:3.
Een vertegenwoordiger van het bestuursorgaan wordt voor het horen uitgenodigd en wordt in de gelegenheid gesteld een toelichting op het standpunt van het bestuursorgaan te geven.
Het advies van de commissie wordt schriftelijk uitgebracht en bevat een verslag van het horen.
Indien de beslissing op het bezwaar afwijkt van het advies van de commissie, wordt in de beslissing de reden voor die afwijking vermeld en wordt het advies met de beslissing meegezonden.
