In this paragraph, the term surviving relatives shall be understood to mean the parents, the spouse or the registered partner, and the children. The powers accruing to the surviving relatives may be exercised by each of them independently. In the event of a difference of opinion, the court may give a decision that is binding upon them.
In this paragraph, research organisation shall mean a university, including its libraries, a research institution or any other entity the primary goal of which is to conduct scientific research or to carry out educational activities that also include the conducting of scientific research:
without a profit motive or by reinvesting all profits into its scientific research, or
on the basis of a task of public interest recognised by a state that is a party to the European Union or the European Economic Area;
in such a manner that access to the results produced by such scientific research cannot be utilised on a preferential basis by an undertaking that exercises a decisive influence on this type of organisation.
For the purposes of this section, text and data mining shall mean any automated analytical technique aimed at the analysis of text and data in digital form in order to generate information including, but not limited to, patterns, trends and correlations.
In this Section, a cultural heritage institution is understood to mean: a library accessible to the public or a museum accessible to the public, an archive, or an institution for cinematographic or audio(visual) heritage.
In deze paragraaf worden onder nabestaanden verstaan de ouders, de echtgenoot of de geregistreerde partner en de kinderen. De aan de nabestaanden toekomende bevoegdheden kunnen zelfstandig door ieder van hen worden uitgeoefend. Bij verschil van mening kan de rechter een voor hen bindende beslissing geven.
In deze paragraaf wordt onder onderzoeksorganisatie verstaan een universiteit, inclusief de bibliotheken ervan, een onderzoeksinstelling of een andere entiteit die hoofdzakelijk tot doel heeft wetenschappelijk onderzoek te verrichten of onderwijsactiviteiten te verrichten die ook de verrichting van wetenschappelijk onderzoek omvatten:
zonder winstoogmerk of door herinvestering van alle winst in haar wetenschappelijk onderzoek, of
op grond van een door een staat die partij is bij de Europese Unie of Europese Economische Ruimte, erkende taak van algemeen belang;
op zodanige wijze dat de toegang tot de door zulk wetenschappelijk onderzoek voortgebrachte resultaten niet op preferentiële basis kan worden aangewend door een onderneming die een beslissende invloed heeft op dit soort organisatie.
In deze paragraaf wordt onder tekst- en datamining verstaan een geautomatiseerde analysetechniek die gericht is op de ontleding van tekst en gegevens in digitale vorm om informatie te genereren zoals, maar niet uitsluitend, patronen, trends en onderlinge verbanden.
In deze paragraaf wordt onder instelling voor cultureel erfgoed verstaan: een voor het publiek toegankelijke bibliotheek of een voor het publiek toegankelijk museum, een archief of een instelling voor cinematografisch of audio(visueel) erfgoed.
