The payment of the compensation referred to in Article 16h shall be made to a legal person to be designated by Our Minister of Justice and Security, which, in his judgment, is representative and which is exclusively charged with the collection and distribution of this compensation.
In matters concerning the collection of the remuneration, the legal person referred to in the first paragraph shall represent the authors or their successors in title in and out of court.
The legal entity referred to in the first paragraph shall apply regulations for the distribution of the collected remuneration. The regulations require the approval of the Supervisory Board (College van Toezicht) referred to in the Collective Management of Copyright and Related Rights (Supervision) Act.
The legal entity referred to in the first paragraph is subject to the supervision of the Supervisory Board (College van Toezicht) referred to in the Collective Management Organisations (Copyright and Related Rights) Supervision Act.
The first and second paragraphs shall not apply insofar as the person who is obliged to pay the remuneration can demonstrate that he has agreed with the author or his successor in title that he shall pay the remuneration directly to them.
De betaling van de vergoeding, bedoeld in artikel 16h, dient te geschieden aan een door Onze Minister van Justitie en Veiligheid aan te wijzen, naar zijn oordeel representatieve rechtspersoon, die met uitsluiting van anderen belast is met de inning en de verdeling van deze vergoeding.
In aangelegenheden betreffende de inning van de vergoeding vertegenwoordigt de rechtspersoon, bedoeld in het eerste lid, de makers of hun rechtverkrijgenden in en buiten rechte.
De rechtspersoon, bedoeld in het eerste lid, hanteert voor de verdeling van de geïnde vergoedingen een reglement. Het reglement behoeft de goedkeuring van het College van Toezicht, bedoeld in de Wet toezicht collectieve beheersorganisaties auteurs- en naburige rechten.
De rechtspersoon, bedoeld in het eerste lid, staat onder toezicht van het College van Toezicht, bedoeld in de Wet toezicht collectieve beheersorganisaties auteurs- en naburige rechten.
Het eerste en tweede lid vinden geen toepassing voorzover degene die tot betaling van de vergoeding verplicht is, kan aantonen dat hij met de maker of zijn rechtverkrijgende overeengekomen is dat hij de vergoeding rechtstreeks aan deze zal betalen.
