in forceOld-age pension and the supplementary allowance · § Granting, commencement, revocation, revision and payment of the old-age pension
Without prejudice to the provisions elsewhere in this Act regarding the revision or revocation of a decision granting an old-age pension and regarding the refusal of an old-age pension, the Social Insurance Bank shall revise or revoke such a decision:
if the failure to perform or the improper performance of an obligation pursuant to Article 15, paragraph 2, or 49, has led to the old-age pension being granted incorrectly or in an excessive amount;
if the old-age pension has otherwise been granted incorrectly or in an amount that is too high;
if the failure to perform, or the improper performance of, the obligation referred to in Article 15, paragraph 2, or Article 49, leads to a situation in which it cannot be established whether a right to an old-age pension still exists.
If there are compelling reasons to do so, the Social Insurance Bank (Sociale verzekeringsbank) may decide to refrain, in whole or in part, from revision or revocation.
Onverminderd het elders in deze wet bepaalde terzake van herziening of intrekking van een besluit tot toekenning van ouderdomspensioen en terzake van weigering van ouderdomspensioen, herziet de Sociale verzekeringsbank een dergelijk besluit of trekt zij dat in:
indien het niet of niet behoorlijk nakomen van een verplichting op grond van artikel 15, tweede lid, of 49, heeft geleid tot het ten onrechte of tot een te hoog bedrag verlenen van ouderdomspensioen;
indien anderszins het ouderdomspensioen ten onrechte of tot een te hoog bedrag is verleend;
indien het niet of niet behoorlijk nakomen van de verplichting bedoeld in artikel 15, tweede lid, of 49, ertoe leidt dat niet kan worden vastgesteld of nog recht op ouderdomspensioen bestaat.
Indien daarvoor dringende redenen aanwezig zijn kan de Sociale verzekeringsbank besluiten geheel of gedeeltelijk van herziening of intrekking af te zien.
