The association named Koninklijke Notariële Beroepsorganisatie, having its registered office in 's-Gravenhage, shall be dissolved by operation of law at the time of the entry into force of this Act and shall be succeeded by the KNB by operation of law under universal title. The board of the KNB is authorised to take all measures and decisions resulting from the legal succession.

Our Ministers for Legal Protection and for Economic Affairs and Climate Policy shall, for a period of three years following the entry into force of the Act, jointly establish annually by ministerial regulation tariffs or a tariff system for the determination of the fee that the civil-law notary charges the client. That regulation shall leave Article 56 unimpaired. The civil-law notary is prohibited from charging the client a fee that is not in accordance with that ministerial regulation. Article 54 shall not apply during that period.

The rates shall be determined in such a manner that a gradual transition to a system of free rate-setting is effected. In doing so, account shall be taken of the notarial rates for official acts as they most recently applied pursuant to Article 59 of the articles of association of the former association Royal Notarial Professional Organization (Koninklijke Notariële Beroepsorganisatie).

Our Minister shall, in agreement with Our Minister of Economic Affairs and Climate Policy, send a report to the States General as soon as possible after the expiry of a period of two years following the entry into force of this Act regarding the consequences of the transitional arrangement of the second and third paragraphs concerning the continuity and accessibility of notarial services during that period. The reports referred to in Article 128 concerning that period shall be incorporated into the report. The report shall also contain a conclusion regarding the question of whether there is reason to apply Article 54 after the end of the transitional arrangement.

De vereniging genaamd Koninklijke Notariële Beroepsorganisatie en gevestigd te 's-Gravenhage wordt van rechtswege ontbonden op het tijdstip van de inwerkingtreding van deze wet en wordt van rechtswege onder algemene titel opgevolgd door de KNB. Het bestuur van de KNB is bevoegd tot het nemen van alle maatregelen en beslissingen die uit de rechtsopvolging voortvloeien.

Onze Ministers voor Rechtsbescherming en van Economische Zaken en Klimaat stellen gedurende een periode van drie jaar na inwerkingtreding van de wet gezamenlijk jaarlijks bij ministeriële regeling tarieven of een tarievenstelsel vast ter bepaling van het honorarium dat de notaris de cliënt in rekening brengt. Die regeling laat artikel 56 onverlet. Het is de notaris verboden aan de cliënt een honorarium in rekening te brengen dat niet in overeenstemming is met die ministeriële regeling. Artikel 54 is niet van toepassing gedurende die periode.

De tarieven worden zodanig vastgesteld dat een geleidelijke overgang wordt bewerkstelligd naar een vrije tariefsvorming. Daarbij wordt rekening gehouden met de notariële tarieven voor ambtshandelingen, zoals deze laatstelijk hebben gegolden krachtens artikel 59 van de statuten van de voormalige vereniging Koninklijke Notariële Beroepsorganisatie.

Onze Minister zendt in overeenstemming met Onze Minister van Economische Zaken en Klimaat zo spoedig mogelijk na verloop van een periode van twee jaar na de inwerkingtreding van deze wet aan de Staten-Generaal een verslag over de gevolgen van de overgangsregeling van het tweede en derde lid betreffende de continuïteit en de toegankelijkheid van de notariële dienstverlening in die periode. In het verslag worden de in artikel 128 bedoelde rapporten over die periode verwerkt. Het verslag bevat tevens een conclusie met betrekking tot de vraag of er aanleiding is tot toepassing van artikel 54 na het einde van de overgangsregeling.
