If any investigation by the examining magistrate proves necessary, the court shall, while suspending the proceedings at the hearing and indicating the subject of the investigation and, if necessary, the manner in which it is to be conducted, place the documents in the hands of the examining magistrate.
In the event that the investigation consists exclusively of hearing witnesses or of commissioning, appointing and hearing experts, the court may refer the case to the examining magistrate (rechter-commissaris) or, if the public prosecutor and the defendant consent thereto, designate the presiding judge or one of the judges adjudicating the case as examining magistrate (rechter-commissaris). This judge may participate in the further investigation at the hearing, unless it has been determined during the hearing of witnesses or experts that the defendant or their counsel may not be present thereat.
The investigation shall be conducted in accordance with the provisions of the second up to and including the fifth and seventh sections of the Third Title of this Book.
Indien enig onderzoek door de rechter-commissaris noodzakelijk blijkt, stelt de rechtbank met schorsing van het onderzoek ter terechtzitting onder aanduiding van het onderwerp van het onderzoek en, zo nodig, van de wijze waarop dit zal zijn in te stellen, de stukken in handen van de rechter-commissaris.
In het geval het onderzoek uitsluitend zal bestaan in het horen van getuigen of het verlenen van een opdracht aan, het benoemen en horen van deskundigen kan de rechtbank de zaak verwijzen naar de rechter-commissaris dan wel, indien de officier van justitie en de verdachte daarmee instemmen, de voorzitter of een der rechters die over de zaak oordelen als rechter-commissaris aanwijzen. Deze rechter kan aan het verdere onderzoek ter terechtzitting deelnemen, tenzij bij het horen van getuigen of deskundigen is bepaald dat de verdachte of diens raadsman daar niet bij tegenwoordig mag zijn.
Het onderzoek wordt overeenkomstig de bepalingen van de tweede tot en met de vijfde en zevende afdeling van de Derde Titel van dit Boek gevoerd.
